Builders Licensing (Amendment) 1987
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:
Short title
1. This Act may be cited as the "Builders Licensing (Amendment) Act
1987".
Commencement
2. (1) Sections 1 and 2 shall commence on the date of assent to this
Act.
(2) Except as provided by subsection (1), this Act shall commence on the commencement of the Building Services Corporation Act 1987.
Amendment of Act No. 16, 1971
3. The Builders Licensing Act 1971 is amended in the manner set forth
in Schedule 1.
Amendment of Act No. 107, 1984
4. The Builders Licensing (Amendment) Act 1984 is amended by omitting from Schedule 4 the word "Board" wherever occurring and by inserting instead the word "Corporation".

DIVISION I—Education Fund
Education Fund
39. (1) The Corporation shall establish in its books a Licensed
Builders Education Fund consisting of—
(a)
the amount in the Licensed Builders Education and Research Fund established under this section as in force before the commencement of the Building Services Corporation Act 1987; and
(b) amounts paid to the Fund under section 11 of that Act.
(2) The Corporation may make payments from the Education
Fund towards—
(a)
encouraging, by subsidy or otherwise, apprenticeship in the building industry;
(b) assisting education or research related to the building
industry; or (c)
assisting any public purpose connected with the building industry.
DIVISION 2—Insurance Fund
Insurance Fund
40. (1) The Corporation shall establish in the books of the Coiporation the Building Services Insurance Fund consisting of the amounts paid to the Fund under section 11 of the Building Services Corporation Act 1987.

(2) The Corporation shall, from the Insurance Fund, discharge any liability on its part to make—
(a)
payments under house purchasers' agreements referred to in section 34 and trade indemnity agreements under section 34A;
(b) payments to underwriters; and
(c) refunds under section 38A or 38B.
DIVISION 3—Building Services Corporation Trust Account
Building Services Corporation Trust Account
41. (1) The Corporation shall establish in a bank in New South Wales a Building Services Corporation Trust Account and shall deposit in the account—
(a)
the amount in the Builders Licensing Board Trust Account established under this Division as in force before the commencement of the Building Services Corporation Act 1987:
(b)
the amounts directed to be paid to the Corporation under section 30B (1); and
(c) the income from investments made under subsection (2). (2) The Trust Account may be used—
(a) to make payments under section 30B (2) or (3); and
(b)
for investment by deposit with a bank in New South Wales.
(13) Section 49 (General powers of the Board)—
(a)
Section 49 (1), (1A), (2), (4)— Omit "Board" wherever occurring, insert instead "Corporation".
