Builders Labourers' Federation (Cancellation

of Registration—Consequential Provisions)

Regulations

WHEREAS, in the case of each organization (being an organization of employees that is registered under the Conciliation and Arbitration Act 1904) specified in Part I of a Schedule to these Regulations, the Secretary or another executive officer of that organization has consented in writing to persons who are, or are usually, employed—

(a) in work of a kind or class normally performed by persons in a classification specified in column 2 of an item, or of the item, in Part II of that Schedule;

(b) in the part or parts of Australia specified in column 3 of that item; and

(c) in a relevant industry within the meaning of section 7 of the Builders Labourers' Federation (Cancellation of RegistrationConsequential Provisions) Act 1986,

being made eligible for membership of that organisation:

NOW THEREFORE I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Builders Labourers' Federation (Cancellation of RegistrationConsequential Provisions) Act 1986.

Citation

1.These Regulations may be cited as the Builders Labourers' Federation (Cancellation of Registration—Consequential Provisions) Regulations.

Interpretation

2. (1) In these Regulations, unless the contrary intention appears

"Bricklayer's Labourer refractory brick work" has the same meaning as in the award known as the "State Electricity Commission of Victoria Building Construction Employees and Builders' Labourers' Award, 1979";

"Operator Floor Sanding and/or Smoothing Machine" has the same meaning as in the award known as the "Builders' Labourers' (Australian Capital Territory) Award 1982";

"organization" means an organization of employees that is registered under the Conciliation and Arbitration Act;

"relevant industry" has the same meaning as in section 7 of the Act;

"the Act" means the Builders Labourers' Federation (Cancellation of RegistrationConsequential Provisions) Act 1986.

(2) For the purposes of Schedule 1, "Tackle Hand" has

(a) in item 2 the same meaning as in the award known as the "Builders Labourers (Mixed Industries) Award, 1963"; and

(b) in item 3 the same meaning as in the award known as the "Builders' Labourers' (Australian Capital Territory) Award 1982".

(3) For the purposes of Schedule 2, "Pile Driver" has—

(a) in item 1 the same meaning as in the award known as the "Builders' Labourers' (Australian Capital Territory) Award 1982"; and

(b) in item 2 the same meaning as in the award known as the "Builders Labourers (Mixed Industries) Award, 1963".

(4) A word or expression used in column 2 of a Schedule, being a word or expression used in the award known as the "Building Construction Employees and Builders Labourers (Consolidated) Award 1982", has in that Schedule the same meaning as in the award.

(5) In this regulation, a reference to an award shall be read as a reference to that award as varied and in force immediately before the commencement of the Builders Labourers' Federation (Cancellation of Registration) Act 1986.

Declaration

3. It is hereby declared that persons who are, or are usually, employed—

(a) in work of a kind or class normally performed by persons in a classification specified in column 2 of an item, or of the item, in Part II of a Schedule;

(b) in the part or parts of Australia specified in column 3 of that item; and

(c) in a relevant industry,

are eligible for membership of the organization specified in Part I of that Schedule.

Labourer excavating ground for foundations or basements of buildings or levelling ground on a proposed building site or doing concrete work, tar paving or asphalt work or mortar or concrete mixing in connection with or incidental to the construction, repair, demolition or removal of buildings

Rigger performing rigging work that is an integral part of, or is incidental to, a tradesman's work

Assistant Rigger assisting a rigger specified in the immediately preceding classification
