HIS HONOUR:   This was an application for a stay of orders of the Full Federal Court pending the determination of an application for special leave to appeal to this Court.  In my opinion, the application for a stay should be refused.  I publish my reasons. 

Does the respondent ask for costs of the application?

MR T. EVANS:   It does, your Honour.

HIS HONOUR:   Does it ask me to certify for counsel?

MR EVANS:   It does, your Honour.

HIS HONOUR:   Is there any reason why the order for costs should not be made, Mr Bryant?

MR BRYANT:   Not that I know of, your Honour.

HIS HONOUR:   The application is refused with costs.  I certify for counsel.  I will leave it to the Taxing Officer of the Court to determine whether it was appropriate that senior counsel should be present.

MR EVANS:   It if please your Honour.

HIS HONOUR:   Court will adjourn.

AT 10.01 AM THE MATTER WAS CONCLUDED
