BRUNSWICK HEADS HARBOUR WORKS ACT.

A c t No. 4 1 , 1 9 6 0 .

An Act to sanction and to provide for the carrying out of works for the Brunswick Heads Harbour; to validate certain matters; and for purposes connected therewith. [Assented to, 4th November,

1960.]

BE it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as
follows : —

(1) This Act may be cited as the "Brunswick Heads Harbour Works Act, 1960".

(2) This Act shall be deemed to have commenced upon the first day of November, one thousand nine hundred and fifty-nine.

(c) The Minister for Public Works is empowered to carry out the said work and shall be the constructing authority for the same within the meaning of the said Act, as so amended, and shall enter into such contracts and take all such necessary steps for the proper execution thereof as such authority may think proper. (d)

(1) (a) The carrying out of the work described in the Schedule to this Act is hereby sanctioned.

(b) The said work shall be deemed to be an authorised work within the meaning of the Public Works Act,

1912, as amended by subsequent Acts.

(d) The provisions of the Public Works Act, 1912, as amended by subsequent Acts, sections thirty-four, thirty-five, thirty-six and thirty-seven excepted, shall apply to and in respect of the said work.

(2) Without prejudice to the generality of subsection one of this section the provisions of section thirty-eight of the Public Works Act, 1912, as amended by subsequent Acts, shall apply to and in respect of any contracts referred to in paragraph (c) of subsection one of this section.

3. The plan of the said work is the plan marked "Brunswick Heads Harbour Works" signed by the Minister for Public Works and countersigned by the Director of Public Works and deposited in the public office of the said Minister.

4. The cost of carrying out the said work (exclusive of land resumptions) is estimated at two hundred and forty thousand pounds and such estimated cost shall not, under any circumstances, be exceeded by more than ten per centum.

SCHEDULE.

Works for the Brunswick Heads Harbour comprising: —

(1) The construction of a breakwater on the north side of

the Brunswick River entrance extending in an easterly

direction a distance of approximately eight hundred and
forty feet from the existing foreshore.

(2) The construction of a breakwater on the southern side of the Brunswick River entrance extending in an easterly direction a distance of approximately one thousand two hundred and thirty feet from the existing foreshore.

(3) The construction of a training wall on the north side of the main arm of the Brunswick River approximately one thousand seven hundred feet long.

(4) The construction of a training wall on the eastern side of the south arm of the Brunswick River approximately eight hundred feet long.

(5) The construction of a boat harbour on the southern side of the main arm of the Brunswick River, dredged to a depth of eight feet below Indian Spring Low Water, with dredgings placed on adjacent Crown lands for the purpose of reclaiming those lands.

(6) The construction of a bridge, approximately two hundred and ten feet long across the south arm of the Brunswick River, to give access to the breakwater on the southern side of the entrance.

(7) Other incidental works as deemed necessary or desirable

by the constructing authority.

The whole of the works hereinbefore described to be subject to such modifications as may be deemed necessary or desirable by the constructing authority.
