  1. The appeal foreshadowed by this application for special leave to appeal does not enjoy sufficient prospects of success overall to warrant the grant of special leave. Consequently, the foreshadowed appeal is not a suitable vehicle for the agitation of the question concerning the application in this case of the principle in Briginshaw v Briginshaw (1938) 60 CLR 336. The application for special leave should be refused.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
