HER HONOUR: Pursuant to rule 13.03.1 of the High Court Rules 2004 (Cth), the Court directed that the summons filed by the plaintiff on 26 May 2016 be determined on the papers. The Court orders:

1.Pursuant to rule 21.05.1(c) of the Rules, Jessica Anne Willis Hoyt be joined as the second plaintiff.

2.On or before 4.00 pm on 11 July 2016, the plaintiffs file and serve an amended statement of claim in the terms of the amended statement of claim attached to the outline of submissions on the summons for joinder of a party filed by the first plaintiff on 5 July 2016.

3.On or before 4.00 pm on 18 July 2016, the defendant file and serve an amended defence.

4.On or before 4.00 pm on 25 July 2016, the plaintiffs file and serve any reply to the amended defence.

5.On or before 4.00 pm on 10 August 2016, the plaintiffs serve a draft special case on the defendant.

6.On or before 4.00 pm on 26 August 2016, the defendant serve any proposed changes or additions to the draft special case on the plaintiffs.

7.On or before 4.00 pm on 2 September 2016, the plaintiffs file and serve any agreed special case.

8.The matter be relisted for further directions on 6 September 2016 at 9.30 am.

9.The parties have liberty to apply to a Justice on three days’ written notice.
