AN ACT to enable the Brookton Road Board to acquire certain land for a Recreation Reserve, to improve the same, and for the control and management thereof by

the Board, and to authorise the grant of Reserve A 16183

to the Board, with power to sell and apply the proceeds in or towards the purchase and improvement of other land to be so acquired.

this present Parliament assembled, and by the authority of

the same, as follows :—

Short title.

1. This Act may be cited as the Brookton Recreation

Reserve Act, 1925.

2. (1) The Governor may grant to the Brookton Road Board (hereinafter referred to as "the Board ") the land described in Part I. and Part of the Schedule to this Act for an estate in fee simple.

(2) The Board is hereby empowered to purchase or acquire the land described in Part III. of the Schedule to this Act by agreement with the owners, or as for a public work under and subject to the Public Works Act, 1902.

(3) The land so granted to the Board and so pur- chased or acquired shall constitute the Brookton Recreation Reserve (hereinafter referred to as " the Reserve "), and shall be held by the Board as a ground for exhibitions and sports and for the purpose of public entertainment, under and subject to the provisions of this Act.

Lot 337) for an estate in fee simple, with power to sell the same on condition that the proceeds of sale are applied in or towards the purchase or acquisition of the land men- tioned in subsection (2) of section two of this Act, and. the improvement of " the Reserve."

4.    (1) The Board may improve " the Reserve " and Powers of the

set apart portions of " the Reserve " for and may con- struct thereon show grounds, a racecourse, tennis courts, cricket, football, bowling, croquet grounds, and other improvements, and may provide, maintain, manage, and control grandstands, pavilions, refreshment rooms, shelter sheds, kiosks, and other buildings and structures, and may conduct or authorise public entertainments and exhibitions.

(2) The Board may lease portions of " the Reserve " for any of such purposes : Provided that no such lease shall be granted for a term exceeding three years without the consent in writing of the Governor.

6.    (1) The Board may make by-laws for all such matters By-laws.

and things as it may be necessary or convenient to pre- scribe for the purpose of carrying the purposes and objects of this Act into effect, or for the use, control, and manage- ment of " the Reserve " or any part thereof, and the buildings and structures thereon ; and may impose a penalty not exceeding ten pounds for the breach of any by-law.

(2) The power to make by-laws shall include power to prescribe and levy tolls and charges for the right to enter and make use of " the Reserve " or any enclosure, building, or structure situated or being thereon.

PART I.

Reserve A A 9014 (Brockton) ; part of Reserve A 10161 comprising Brookton Suburban Lots 256 and 262; Reserve A 13286 (Brookton), and the land lying between Montgomery Street and the North-East boundary of Brookton Suburban Lot 263, as delineated and coloured red on a plan deposited in the Department of Lands and Surveys and indorsed "Plan referred to in the Brookton Recreation Reserve Act, 1925."

PART IL

That portion of Whittington Street from the West corner of Suburban Lot 270 to the South-West side of Montgomery Street, and those portions of the other streets and of the way lying between the Reserves and Lots mentioned in Part I. and Part III. of this Schedule, as delineated and coloured blue on the said plan.

PART III.

Brookton Suburban Lots 255, 257, 258, 259, 260, 261, 263, 266, 267. and 270, as delineated and coloured green on the said plan.
