Act N o . 142 , 1980 .

An Act to amend section 87A of the Broken Hill Water and
Sewerage Act, 1938, to extend the class of persons eligible

for rating concessions. [Assented to, 10th December, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Broken Hill Water and

Sewerage (Rating) Amendment Act, 1980".

(1) Except as provided by subsection ( 2 ) , this Act shall commence on the date of assent to this Act.

(2) Section 3 and Schedule 1 shall be deemed to have commenced on 1st January, 1980.

3. The Broken Hill Water and Sewerage Act, 1938, is amended in the manner set forth in Schedule 1.

4.       (1) In this section, a reference to a provision of section

87A is a reference to a provision of section 87A of the Broken Hill

Water and Sewerage Act, 1938, as amended by this Act.

(2) Where, in respect of a rate levied by the Broken Hill Water Board for the year commencing on 1st January, 1980— (a) an application is made to the Board under section	87A (3) or (5) by a person entitled to make the
application; and

(b) the person has, before the date on which the application is made, paid, in whole or in part, the rate or a rating contribution in respect of the rate,

the Board shall refund to the person the amount by which the rate is required to be reduced under section 87A (3) or (5) to the extent, if any, to which the rate or rating contribution has been overpaid.

Section 87A ( 1 ) , definition of "eligible pensioner"—

(a) In paragraph (a) (i), after "Part IV", insert "or a benefit under Part IVAAA".

(b) From paragraph (a) ( i ) , omit "Consolidation".

(c)	From paragraph (a), omit "medical service entitle­ ment", insert instead "health benefits".
(d)	From paragraph (a), omit "Services" where secondly occurring, insert instead "Security".
(e)	From paragraph (b), omit "medical service entitle­ ment" wherever occurring, insert instead "health benefits".
(f)	From paragraph (b), omit "Services" wherever occurring, insert instead "Security".
