I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Broken Hill Local Environmental Plan 2013 (Amendment No 3).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at Airport Road, Broken Hill, being Lot 1, DP 1162606.

4      Maps

The maps adopted by Broken Hill Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5 Amendment of Broken Hill Local Environmental Plan 2013

Schedule 1 Additional permitted uses

Insert at the end of the Schedule, with appropriate clause numbering:

Use of certain land at Airport Road, Broken Hill

(1)

This clause applies to land at Airport Road, Broken Hill, being Lot 1, DP 1162606 and identified as “2” on the Additional Permitted Uses Map.

(2)

Development for the purposes of an animal pound is permitted with

development consent.

(3)

In this clause, animal pound means a building or place owned or controlled by a public authority or non-profit community organisation that is used for the keeping or caring of animals (other than for the agistment of horses), and includes any associated ancillary veterinary hospital.
