The Australian Communications and Media Authority makes the following instrument under paragraph 19(1)(b) and subsection 26(2) of the Broadcasting Services Act 1992.

This is the Broadcasting Services (Technical Planning) Guidelines (Consequential Amendments) Instrument 2017 (No. 1).
2 Commencement
Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table.

3 Authority
This instrument is made under paragraph 19(1)(b) and subsection 26(2) of the Broadcasting Services Act 1992.
4 Amendments to licence area plans made under subsection 26(1) of the Broadcasting Services Act
Each of the licence area plans specified in the table in Schedule 1 is amended by omitting the words “Broadcasting Services (Technical Planning) Guidelines 2007”, wherever occurring, and substituting the words “Broadcasting Services (Technical Planning) Guidelines 2017”.
5 Amendments to television licence area plans made under subsection 26(1B) of the Broadcasting Services Act
Each of the television licence areas plans specified in the table in Schedule 2 is amended by omitting the words “Broadcasting Services (Technical Planning) Guidelines 2007”, wherever occurring, and substituting the words “Broadcasting Services (Technical Planning) Guidelines 2017”.
6 Amendments to the Broadcasting Services Clarification Notice 2016
The instrument that is specified in Schedule 3 is amended as set out in the applicable items in that Schedule.

1 Section 4, definition of ancillary communication service
Omit the words “has the meaning given in Appendix 2 to the Broadcasting Services (Technical Planning) Guidelines 2007;”, substitute “means a separate supplementary information service carried on a modulated sub-carrier of an FM transmission.”
2 Section 4, after definition of ancillary communication service
Insert:
FM radio band has the meaning given in Broadcasting Services (Technical Planning) Guidelines 2017, as in force from time to time.
3 Paragraph 6(1)(b)
Omit the words “FM radio broadcasting band”, substitute “FM radio band”.
