Broadcasting Services (Digital-Only Local Market Areas for the Regional Victoria TV1 and Eastern Victoria TV1 Licence Areas) Determination (No.1) 2010

I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subclause 5F(1) of Schedule 4 to the Broadcasting Services Act 1992.

1.         Name of Determination

This Determination is the Broadcasting Services (Digital-Only Local Market Areas for the Regional Victoria TV1 and Eastern Victoria TV1 Licence Areas) Determination (No. 1) 2010.

2.         Commencement

This Determination commences on the day it is registered on the Federal Register of Legislative Instruments.

3.         Definitions

In this Determination:

digital-only local market area has the same meaning given by clause 5F of Schedule 4 to the Act;

local market area has the same meaning given by clause 5F of Schedule 4 to the Act;

Mesh Blocks refers to the geographical units set out in 1209.0.55.002 – Mesh Blocks Digital Boundaries, Australia, 2006 as published by the Australian Bureau of Statistics on 29 February 2008;

Regional Victoria TV1 and Eastern Victoria TV1 licence areas are the areas determined by the Australian Communications and Media Authority in Licence Area Plan: Regional Victoria Television made under subsection 26(1) of the Act; and

the Act means the Broadcasting Services Act 1992.

4.         Determination

(a) For the purposes of Schedule 4 to the Act, the following areas within the Regional Victoria TV1 and Eastern Victoria TV1 licence areas are local market areas:

(i)the area covered by the Mesh Blocks specified at Schedule 1 to this Determination; and

(ii)the area covered by the Mesh Blocks specified at Schedule 2 to this Determination.

(b)        For the purposes of Schedule 4 to the Act:

(i)the local market area specified under paragraph 4(a)(i) is to become a digital-only local market area from and including 29 November 2010; and

(ii)the local market area specified under paragraph 4(a)(ii) is to become a digital-only local market area from and including 3 December 2010.
