I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy, make the following Determination under subclause 5F(1) of Schedule 4 to the Broadcasting Services Act 1992.

1. Name of Determination
This Determination is the Broadcasting Services (Digital-Only Local Market Areas for Regional Queensland TV1) Determination (No. 1) 2011.
2. Commencement
This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.
3. Definitions
In this Determination:
ACMA means the Australian Communications and Media Authority;
census collection district means a geographical area designated by the Australian Bureau of Statistics in the Australian Standard Geographical Classification as a Census Collection District for the purposes of the 2006 Census of Population and Housing;
digital-only local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
local market area has the same meaning given by clause 5F of Schedule 4 to the Act;
Regional Queensland TV1 licence area is the area determined by the ACMA in the Licence Area Plan Regional Queensland Analog Television made under subsection 26(1) of the Act;
the Act means the Broadcasting Services Act 1992.
4. Determination
(a) For the purposes of Schedule 4 to the Act, the area within the Regional Queensland TV1 licence area, with the exception of the area identified by the census collection districts specified at Schedule 1 to this Determination, is a local market area.
(b) For the purposes of Schedule 4 to the Act, the local market area specified under paragraph 4(a) is to become a digital-only local market area from and including 6 December 2011.
