Broadcasting (National Metropolitan Radio Plan) Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Broadcasting Act 1942.

Citation

1. These Regulations may be cited as the Broadcasting (National Metropolitan Radio Plan) Regulations.

Interpretation

2. In these Regulations:

"the Act" means the Broadcasting Act 1942.

Rate of interest on repaid deposits

3. For the purposes of subsection 89DAO (4) of the Act, the rate is determined to be the rate of 14.026% per annum.

Determining order of licensees whose bids are the same

4. (1) For the purposes of subsection 89DAH (5) of the Act, the order in which the names of licensees whose bids are the same are to be set out on the list shall be determined by:

(a) allocating to each such licensee an identifying number;

(b) placing in a container, in respect of each such licensee, an object bearing the identifying number of that licensee (each such object being, except for its identifying number, identical);

(c) withdrawing each object from the container, one at a time, in circumstances that will ensure that the person withdrawing the object is unable to distinguish between the objects in the container at the time of so withdrawing an object; and

(d) setting out on the list the name of each such licensee in the order in which the object bearing the identifying number allocated to the licensee was withdrawn from the container.

(2) A licensee or licensees referred to in subregulation (1), or a person, or a representative of a body, representing that licensee or those licensees, shall be entitled to be present during the procedure referred to in subregulation (1).
