Limited, a duly incorporated joint stock company registered under *" The British Companies Act of 1886," is carrying on within the State• of Queensland the business of importing, storing, treating, packing, and disposing of oils and other commodities, and for the purposes of its said business has acquired and now holds within the Shire of Toombul, in the said State, certain lands for an estate in fee-simple, being Portion 95, County of Stanley, Parish of Toombul, and has been granted by and now holds from the Crown certain lands under perpetual lease, being Perpetual Country Leases Nos. 3698, 3699, 4479, and 4480, Brisbane Land Agent's District : And whereas the said Perpetual Country Leasehold No. 3698 is separated from the said Perpetual Country Leasehold No. 3699 by a public road, and the last- mentioned leasehold is separated from the said Portion 95 by a public road, and the said Perpetual Country Leasehold No. 4479 is separated from the said Portion 95 by a public road, and is •separated from the said Perpetual Country Leasehold No. 4480 by a public road, and the lastmentioned leasehold is separated from the Railway Reserve at and adjacent to ,Pin.kenba, Railway Station by a public road: * 50 Vic. V., And whereas for the purpose of its said business and for the convenient and advantageous use and occupation of its said lands it is necessary that the said Company should construct, manage, maintain, and work two lines of tramway and certain pipes, Conduits, and other works hereinafter mentioned in, along, over, under, and across its said lands, and should be authorised to construct, manage, maintain, and work the same and every of them in, along, over, under, and across the said public roads separating the said lands respec- tively, in order that direct and continuous access to and from the Brisbane River and direct and continuous access to and from the State Railway at Pinkenba Railway Station aforesaid may be afforded to the said lands and the extensive structures and works which it is intended to construct thereon: And whereas the Council of the said Shire of Toombul, being the Local Authority charged with the care, control, and management of the said public roads, so far as it can legally do so has consented to the said proposed works of the said Company so far as the same would exist in or affect the said public roads: And whereas it is manifestly expedient that the said Company should be authorised to construct, manage, maintain, and work the said lines of tramway and pipes, conduits, and other works hereinbefore mentioned in, along, over; under, and across the said public roads within the said Shire, at or near the places respectively delineated on the map in the Schedule to this Act: Be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as " The British Imperial Oil Company's Tramway and Works Act of 1922." Interpreta- 2. In this Act the expression "the Company" tion. means and includes The British Imperial Oil Company Limited, its assigns and successors in interest. Power to construct tramway and other works. 3. (1.) The Company is hereby authorised and empowered to construct, manage, maintain, and work— (a) A tramway in, along, and across the public roads within the Shire of Toombul in the © State of Queensland, namely: the public road separating Perpetual Country Leasehold I

S. 3. 1922. British Imperial Oil Co.'s Tramway and Works Act. No. 3698 aforesaid from Perpetual Country Leasehold No. 3699 aforesaid, and the public road separating Perpetual Country Leasehold No. 3699 aforesaid from Portion 95, County of Stanley, Parish of Toombul, aforesaid, at or near the 'places respectively delineated on the plan in the Schedule to this Act, with all such cables, standards, wires, lines, and other accessories as may be considered necessary or convenient by the Company for the working of the said tramway; and (b) A tramway in, along, and across the public roads within the Shire of Toombul aforesaid, namely: the public road separating Portion 95 aforesaid from Perpetual Country Lease- hold No. 4479 aforesaid, and the public road separating the lastmention.ed leasehold from Perpetual Country Leasehold No. 4480 afore- said, and the public road separating the last- mentioned leasehold from the Railway Reserve at and adjacent to Pinkenba Railway Station aforesaid, with all such cables, standards, wires, lines, and other accessories as may be considered necessary or convenient by the Company for the working of the said tramway; and (c) All such pipes, conduits, lines, and other accessories in, along, over, under, and across the public roads mentioned in paragraph (a) of this subsection, at or near the places respectively delineated on the plan in the said Schedule, as may be considered necessary or convenient by the Company for the carriage, conveyance, and transmission respectively of oils or other fluids, and water, in connection with the business of the Company: Provided that the work of construction of the tram- ways aforesaid in, along, and across the roads aforesaid shall be done by the Company to the satisfaction of the State Commissioner for Railways, and no part of the tramway shall be constructed or reconstructed in, along, or across any road until the plans and sections showing the tramlines and the levels thereof, and all working plans, sections, specifications, and drawings have been submitted to and approved of by the said Commissioner in writing. 10351
10352 s. 1. RAILWAYS AND TRAMWAYS.—WATER. Cairns Hydro-Electric Power, Etc., Board Act. 13 GEO. V. No. 16, Motive power. If the Company or any officer, servant, or agent of the Company shall in the construction, reconstruction, management, maintenance, or working of the said works or any of them Unduly obstruct or endanger the public traffic in, upon, or over the said public roads or any of them, the Company shall be guilty of an offence, and shall for every such offence forfeit to the said Commissioner the sum of one hundred pounds, to be recovered in a summary way by complaint by the said Commissioner under *" The Justices Acts, 1886 to 1909": Provided further that, at any place where •any tramway of the Company is laid in any of the said roads over any water-main of the Metropolitan Water Supply and Sewerage Board, such water-main shall be adequately protected by a shield-pipe by or at the expense of the Company and to the satisfaction of the said Board; and wherever any oil-pipe or water-pipe of the Company is laid in any of the said roads under or over any water- main of the said Board, or under any tramway of the Company, such pipe shall be adequately protected by a shield-pipe. (2.) The Company may use and employ, upon the said tramways hereby authorised, animal traction or engines or motors propelled by steam, electricity, or other motive power and all necessary carriages and wagons.
