British American Tobacco Australia Services Limited v Laurie [2010] HCATrans 223 [2010] HCATrans 223

CaseChat Overview and Summary

British American Tobacco Australia Services Limited (BATAS) and others were the applicants in proceedings before the High Court of Australia, seeking to challenge the validity of certain provisions of the *Tobacco Plain Packaging Act 2011* (Cth) and the *Tobacco Plain Packaging Regulations 2011* (Cth). The respondents were Mr Laurie and others, who were tobacco manufacturers and retailers. The core of the dispute concerned whether these legislative measures constituted an acquisition of property by the Commonwealth otherwise than on just terms, contrary to section 51(xxxi) of the Australian Constitution.

The High Court was required to determine whether the Act and Regulations effected an acquisition of property for the purposes of section 51(xxxi). Specifically, the court had to consider whether the restrictions imposed by the legislation on the use of brand names, logos, and other distinctive trade marks on tobacco packaging amounted to an acquisition of the intellectual property rights associated with those marks. Further, if an acquisition was found, the court had to determine whether it was on "just terms," meaning whether adequate compensation was provided.

The majority of the High Court held that the Act and Regulations did not involve an acquisition of property within the meaning of section 51(xxxi). Their Honours reasoned that while the legislation significantly restricted the use and commercial value of trade marks on tobacco packaging, it did not extinguish or transfer the underlying intellectual property rights themselves. The legislation regulated the *exercise* of those rights in a particular context, rather than acquiring the property itself. Consequently, the constitutional requirement for just terms did not arise.

The applications for special leave to appeal were dismissed.
