W HEREAS in order to improve the Port of Brisbane by rendering the same safer to navigation and increasing the facilities for the passage of vessels up and down tbe River Brisbane it. has become necessary to con- struct in the said River training walls and otber works appurtenant thereto in accordance with reports and plans from time to time presented to Parliament: And whereas the construction of certain of such walls and works, having been approved by the Government of the State and sanctioned by the Marine Board of Queensland, has been commenced and is now being carried on under the direction and su pervision of the Department of Harbours and Rivers by means of moneys appropriated by Parliament for the purpose, and the construction of other like walls and works, as shown by such reports and plans,

Brisbane River Improvement Act. is necessary to complete the scheme of improvement: And whereas doubts have arisen as to the power& of the Government of the State and the said Marine Board in the construction of such walls and works, and it is expedient to set all such doubts at rest: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as " The Brisbane Hivel' Short title. Improvetnent Act 0/1902." 2. In this Act the expression "training walls" means I?-terpreta- and includes the training walls now constructed and in bono course of construction in the River Brisbane at the Hamilton Reach, from Coxen Point to Parker Islet, at Parker Islet, from Queensport to Gibson Island, and at Lytton respectively, and the training walls at Bulwer Island, Fisherman Island, and Luggage Point respectively shown and recommended to be constructed in and by a plan and report for the improvement of the said river presented to Parliament in the year one thousand eight hundred and ninety-eight, together with all banks, reclama- tions of land, buoys, beacons, and other works in connec- tion with such walls and appurtenant to the same or any of them. 3. It is hereby declared to be lawful for the Govern- Const:u?tion ment of the State, out of any moneys from time to time ~ af: : alllmg appropriated by Parliament for the purpose, to construct approved. and hereafter to maintain, repair, renew, modify, extend, and enlarge the training walls in the River Brisbane mentioned in the last preceding section in accordance with plans and specifications approved or to be approved by the Governor in Council. And all acts and works done and executed by the Government of the State and the Marine Board in and about the construction of the training walls aforesaid before the passing of this Act shall be and are hereby declared to have been valid for all purposes. 4. No action, indictment, information, or other pro- Yo action ceeding shall be commenced, presented, prosecuted, or to lie. maintained against the Crown or any officer of the Government or other person for or in respect of the construction, maintenance, repair, renewal, modification, extension, or enlargement of the training walls aforesaid, whether before or after. the passing of this Act, or any

No 28, alleged obstruction of the navigation of the River Brisbane, or deprivation of access to the said River thereby, or for or in respect of any damages, loss, or expenses occasioned or alleged to be occasioned by reason of such construc- tion, maintenance, repair, renewal, modification, extension, enlargement, obstruction, or deprivation, or in anywise whatsoever arising therefrom : Provided that any owner or occupier of land who con- siders that any of the training walls aforesaid, whether already constructed or in course of construction, or recom- mended to be constructed in and by the plan and report aforesaid, has interfered or will interfere, as the case may be, with access to his land, may within three months after the passing of this Act, or in the case of any modification, extension, or enlargement of such training walls, may within six months after the same has been authorised by the Governor in Council, apply in writing to the Treasurer for compensation for such interference with access, and the claim for compensation if not otherwise satisfactorily settled, shall be dealt with in manner provided by " The Public Works Lands Resumption Acts."* LOCAL GOVERNMENT. 2 ~ w.
