2 Brisbane Market Trust Inscribed Stock Amendment (No. 1) No. 105, 1992 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Brisbane Market Trust Inscribed Stock Amendment Regulation (No. 1) 1992 . PART 2—CLOSURE OF DEBT REDEMPTION FUND ˙ Closure of Debt Redemption Fund 2.(1) In this section— “Debt Redemption Fund” means the fund that was, immediately before the commencement of this section, maintained under section 4 of the Brisbane Market Trust Inscribed Stock Regulation 1962. (2) As soon as is practicable, and in any case before 1 July 1992, the body corporate named ‘Trustees of the Brisbane Market Trust Debt Redemption Fund’ must— (a) pay all money in the Debt Redemption Fund to the Trust; and (b) take any other action it considers necessary to discontinue maintenance of the Debt Redemption Fund. ˙ Dissolution of Trustees of the Brisbane Market Trust Redemption Fund 3.(1) On 1 July 1992, the body corporate named ‘Trustees of the Brisbane Market Trust Debt Redemption Fund’ is dissolved. (2) On the dissolution— (a) any assets or liabilities of the body corporate immediately before its dissolution become assets and liabilities of the Trust; and (b) any agreements entered into by or on behalf of the body corporate, existing immediately before its dissolution, are taken to have

3 Brisbane Market Trust Inscribed Stock Amendment (No. 1) No. 105, 1992 been entered into by or on behalf of the Trust; and (c) any actions or proceedings taken by or against the body corporate, existing immediately before its dissolution, are taken to have been taken by or against the Trust. PART 3—AMENDMENT OF BRISBANE MARKET TRUST INSCRIBED STOCK REGULATION 1962 ˙ Amended regulation 4. The Brisbane Market Trust Inscribed Stock Regulation 1962 is amended as set out in this Part. ˙ Replacement of s.1 5. Section 1— omit, insert— ‘Short title ‘1. This regulation may be cited as the Brisbane Market Trust Inscribed Stock Regulation 1962. ’. ˙ Amendment of s.2 6. Section 2 (definitions “Act” and “Fund” )— omit. ˙ Replacement of s.4 7. Section 4— omit, insert—

4 Brisbane Market Trust Inscribed Stock Amendment (No. 1) No. 105, 1992 ‘Repayment of loans ‘4.(1) In this section— “arrangements” for making repayments of a loan include the times at which the repayments are made; “loan” includes the amount of the loan and the interest (if any) payable on the amount. ‘(2) This section applies in relation to each loan made to the Trust, whether existing at, or made at any time after, the day that this section commences. ‘(3) The Trust must not make a repayment of a loan except in compliance with arrangements determined under subsection (4). ‘(4) The arrangements for the repayment of a loan must be— (a) determined by the Trust; and (b) approved in writing by the Treasurer. ’.
