An Act to Amend "The Brisbane Gas Company BRISBANE Ges Limited Acts, 1864 to 1952," in certain COMPANY LIMITED Acs particulars. AMENDMENT ACT OF 1958. [ASSENTED TO 7TH OCTOBER, 1958.] B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1 . (1.) This Act may be cited as " The Brisbane Gas Company Limited Acts Amendment Act of 1958." Principal Act. Collective title. (2.) *" The Brisbane Gas Company Limited Acts, 1864 to 1952," are in this Act referred to as the Principal Act. (3.) The Principal Act and this Act may be collectively cited as " The Brisbane Gas Company Limited Acts, 1864 to 1958." Amendments of s. 50. 2. Section fifty of the Principal Act is amended— (a) By repealing therein all words assigning a meaning to the words "corporation of the City of Brisbane ", and inserting, in lieu of the words so repealed, the words "The words " corporation of the City of Brisbane" shall mean Brisbane City Council under and within the meaning of t" The City of Brisbane Acts, 1924 to 1958 " " ; and * 28 V. and amending Acts. t 15 G. 5 No. 32 and amending Acts.

(b) By adding thereto the following paragraph "References in this Act to the "city of Brisbane" however expressed, shall be taken on and after the passing of *" The Brisbane Gas Company Limited Acts Amendment Act of 1958," to refer to the Area set out in the Schedule to this Act." 821 3. The following sections are inserted after section New es. 50A fifty of the Principal Act, namely :— and 50B inserted. "[50A.] Nothing in this Act or in the memorandum and articles of association of The Brisbane Gas Company Limited shall authorise, or be deemed to authorise, that company to supply gas, or to exercise any of the powers conferred upon it by sections twenty-one, twenty- two, twenty-three, twenty-four and twenty-five of this Act, outside the Area set out in the Schedule to this Act. [50B.] (1.) Subject to this section, the Governor Powers of. in Council may from time to time, by Order in Council =Tr' published in the Gazette, amend the Schedule to this Act— (a) By excluding from the Area set out therein any part of that Area; or (b) By including in the Area set out therein any other area not already included in that Area, and the said Schedule as so amended shall thereupon become for the time being the Schedule to this Act and shall have effect accordingly. (2.) The Governor in Council shall not, pursuant to this section, exclude from the Area set out in the Schedule to this Act any part of that Area, or include in that Area any area not already included therein, save with the prior consent in writing of The Brisbane Gas Company Limited. (3.) The Governor in Council shall not, pursuant to this section, include in the Area set out in the Schedule to this Act any area not already included therein wherein any person or company other than The Brisbane Gas Company Limited is authorised under an Act to supply gas save with the prior consent in writing of that person or company. * This Act.

For the purposes of this subsection a company or person shall be deemed to be not authorised by an Act to supply gas in an area which is not expressly set out in the Act in question." 4. The following Schedule is added to the Principal Act, namely :— " SCHEDULE. BOUNDARIES OF THE AREA. Commencing at a point on the north bank of the Brisbane River at its mouth; thence along the northern bank of the Brisbane River until such northern bank of the Brisbane River intersects the boundary of the city of Brisbane as defined by " The City of Brisbane Acts, 1924 to 1958"; thence along such boundary in a northerly and. then easterly direction to a point of intersection of such boundary with an unnamed road running in a north-south direction, commencing at Gordon road and intersecting Bergin road; thence in a northerly direction until such line intersects with another line running in an east-west direction from the intersection of Hamilton road and the city of Brisbane boundary as defined by " The City of Brisbane Acts, 1924 to 1958 " ; thence along the said line running in an east-west direction to the point where such line intersects the city of Brisbane boundary as defined by " The City of Brisbane Acts, 1924 to 1958 " ; thence along the city of Brisbane boundary as defined by " The City of Brisbane Acts, 1924 to 1958 " ; thence along such boundary in a northerly direction to the intersection of such boundary with Albany Creek road; thence along the southern side of Albany Creek road in an easterly direction to the intersection of Albany Creek road with Cabbage Tree Creek; thence along the south-eastern side of Cabbage Tree Creek in a north-easterly direction to the intersection of Cabbage Tree Creek with Beams road; thence along the southern side of Beams road in an easterly direction to the intersection of Beams road and Sandgate road; thence along the south-western side of Sandgate road in a south-easterly direction to the intersection of Sandgate road and a watercourse known as Zillman Waterholes ; thence along the southern side of the watercourse known as Zillman Waterholes and Nundah Creek in an easterly and northerly direction to the intersection of Nundah Creek and Queen's road; thence along the south-western side of Queen's road in a south-easterly direction to the intersection of Queen's road and Nudgee road; thence along the south-eastern side of Nudgee road in a north-easterly direction to its intersections with Cribb Island road and Green road; thence along the south-western side of Green road in a south-easterly direction to the intersection of Green road and Cribb Island road; thence along the south-eastern side of Cribb Island road in a north-easterly direction to the intersection of Cribb Island road and an unnamed road; thence along the south-eastern side of the said unnamed road in a north-easterly direction to the intersection of the unnamed road and Serpentine Creek; thence along the southern bank of Serpentine Creek in a generally north-easterly direction to the mouth of the said creek; thence along the foreshores of Moreton Bay at high water mark in a general south-easterly direction to the point of commencement on the north bank of the Brisbane River at the mouth."
