[ASSENTED TO 5TH NOVEMBER~ 1912.J W HEREAS it is enacted by section three of "The Preamble. Acclimatisation Society and National Agricultural and Industrial Association Act of 1890"* that, upon the surrender of certain deeds of grant in the said Act referred to, a new deed of grant should, upon certain conditions in the said Act mentioned, issue of certain lands (therein called Exhibition Lands, and which are described in the second part of the Schedule to the said Act, and are also described in the Schedule to this Act), containing twenty- three acres one rood thirty-two and a half perches, to certain persons named in the said Act or to such other Trustees as the Governor in Council might think fit, and their suc- cessors in office, upon trust, for the appropriation thereof to the use and for the grounds of the National Agricultural and Industrial Association of Queensland, and, subject, nevertheless, to the powers in the said Act contained, for no other purposes whatsoever: Provided that the said lands should be subject to an annual rent charge in favour of the Acclimatisation Society of Queensland to the amount of seven hundred and fifty pounds per annum for twenty years from the first day of J'uly, one thousand. eight hundred and ninety, to the thirtieth day of June, one thousand nine hundred and ten: And whereas a new deed of grant of the said lands, No. 78090, was accordingly issued to the Right Honourable Sir Samuel Walker Griffith and the Honourable John Donaldson and John Fenwick as Trustees in pursuance of the said Act : ... 54 Vjc. No. 11, And whereas the said Trustees, under the powers of borrowing and of mortgage vested in them by the said Act, obtained from the Treasurer an advance of thirty thousand pounds, and by Bill of Mortgage dated the twenty-seventh day of July, one thousand eight hundred and ninety-two, and registered in the Real Property Office, No. 259985, mortgaged all their interest in the said lands to secure the repayment of the said sum of thirty thousand pounds with interest: ' And whereas the said Trustees made default in pay- ment of the moneys owing on the secur~ty of the said mortgage, and, in the exercise of the right and power conferred upon him by the said Bill of Mortgage, the Treasurer, on the twenty-first day of December, one thousand eight hundred and ninety seven, entered upon and took possession of the said mortgaged lands and all buildings, materials, machinery, apparatus, and appliances erected upon or connected with the said lands, and has ever since remained in possession thereof: - And whereas the Treasurer duly paid the said annual rent charge to the said Society as and when the same became due from time to time: And whereas the said lands are now released from the said charge: And whereas' the said John Donaldson died on the twenty-fifth day of July, one thousand eight hundred and ninety-six, and the said John :Fenwick died on the four- teenth day of July, one thousand nine hundred, and the -said Sir Samuel Walker Griffith resigned his office as Trustee aforesaid on the twenty-first day of June, one thousand eight hundred and ninety-three, and there are not now any Trustees of the said lands: And whereas it is expedient that the said lands should become and be vested in the Crown, and become subject to the proyisions of this Act: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lat~ ve Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, ~ as follows : - Short title. 1. This Act may be cited as " The Brisbane Exhibi- tion Lands .Act of 1912." Exhibition , 2. 1912. pARKS AND PUBLIC LANDS. Brisbane Exhibition Lands Act. 5749 in trust for the purposes hereinbefore mentioned, is hereby resumed, and the subsisting trusts thereof are hereby determined. From and after the passing of this Act all the said pareel of land shall become Crown land, and shall be dealt with under this Act. The said Deed of Grant, No. 78090, issued in respect of the said land, and the said Bill of Mortgage, No. 259985, are ca:pcelled; and the said Trustees and their respective legal representatives and the National Agricultural and Industrial Association of Queensland are hereby released from all moneys due or payable under the said Bill of Mortgage or in respect of the said advance by the Treasurer or any interest accruing thereon. . 3. The said parcel of land shall be reserved, for such L:1nd to bG ,. public purposes under" The Land Act of 1910"* as the reserved. Governor in Cou,ncil shall think fit; and a lease of the said land or any part thereof may be granted unde!' the said last. mentioned Act to the National Agricultural and Industrial ~ ssociation of Queensland or their representative or re· presentatives for such term and at such rental and subject to such further conditions, covenants, reservations, and stip~ lations as the Governor in Council shall think fit. THE SCHEDULE. County of Stanley, parish of North Brisbane. Commencing at the intersection of the north-west side of Gregory terrace by the north-east side of the Bowen Bridge road, and bounded thence on the south-west by the Bowen Bridge road bearing three hundred and thirty-seven degrees thirty minutes six chains and eighty-seven links; on the north-west by lines bearing sixty degrees fifty-one minutes eight chains and twenty-two links, three hundred and twenty-nine degrees thirty-one minutes forty-three links, fifty-seven degrees twenty-two minutes two chains, forty-nine degrees forty-six minutes two chains, forty-two degrees thirty-nine minutes four chains and seventy and a-half links, thirty-eight degrees .eighteen minutes three chains and thirty-nine links, thirty-two degrees eight minutes two chains and eighty-nine links, and twenty-five degrees nine minutes three chains and twenty-eight links; on the north by O'ConneIl terrace bearing eighty-nine degrees thirty- nine minutes eight chains and eighty.seven links; on the north-east by a road bearing one hundred and fifty-seven degrees forty-six minutes five chains and ninety-four links; and on the south-east by Gregory terrace bearing two hundred and thirty.six degrees three minutes twenty-five chains and eighte~ n links, and two hundred and twenty-nine degrees twenty-seven minutes seven chains imd eighty-nine and six-tenths links to the point of commencement ;-containing twenty-three acres one rood thirty-two and a-half perches. .* l Geo.
