This regulation may be cited as the Brisbane Casino Agreement Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the BrisbaneCasinoAgreementRegulation1993 . ˙ Amendment of sch 2 3. Schedule 2— insert — ‘ PART 4— THIS AGREEMENT is made on 1996 BETWEEN THE STATE OF QUEENSLAND ( “State” ) AND JUPITERS LIMITED ACN 010 741 045 a company duly incorporated and having its registered office at Level 9, Niecon Tower, 17 Victoria Avenue, Broadbeach, Queensland ( “Jupiters” ) RECITALS A The parties are the parties to an agreement made on 6 May 1993 relating to the establishment and operation of a hotel/casino complex in Brisbane in the State of Queensland which was authorised by the Act and as subsequently amended.

s3 3 s3 Brisbane Casino Agreement Amendment (No. 1) No. 389, 1996 B The parties have agreed to amend the Brisbane Casino Agreement in the manner set out in this document. OPERATIVE PROVISIONS Definitions 1. In this document— “Act” means the Brisbane Casino Agreement Act 1992. “Brisbane Casino Agreement” means the agreement referred to in Recital A. Amendment of Jupiters Casino Agreement 2. The parties agree that the Brisbane Casino Agreement is amended by— (a) inserting in clause 1 immediately following the definition of “Planning Scheme Maps”, the following definition— “ “Premium Junket Revenue” means premium junket revenue as defined in the Control Act.” (b) by deleting from clause 76 the words “20% of Casino Gross Revenue for the month in question” and inserting in lieu thereof— “the sum of— (a) 20% of Casino Gross Revenue for the month in question; and (b) 10% of Premium Junket Revenue for the month in question. The rates set out in this clause 76 shall apply from 1 July 1996.” Governing Law 3. The interpretation and construction of this document shall be governed and determined in accordance with the law of Queensland and the parties submit to the non-exclusive jurisdiction of the courts of that State.
