390 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Brisbane and Area Water Board Act Amendment Act 1991. 2. Commencement . (1) This Part and sections 31 and 42 commence on the day this Act is assented to for and on behalf of Her Majesty. (2) The remaining provisions of this Act, or such of them as are specified, commence on a day or on days appointed by Proclamation. 3. Amendment of short title . The Brisbane and Area Water Board Act 1979 is amended in section 1 by omitting the words "Brisbane and Area" and substituting the words "South East Queensland ". 4. Citation . (1) In this Act, the Brisbane and Area Water Board Act 1979-1990 is referred to as the Principal Act. (2) The Principal Act, as amended by this Act, may be cited as the South East Queensland Water Board Act 1979-1991. PART II-AMENDMENTS OF PRINCIPAL ACT 5. Amendment of long title . The long title of the Principal Act is amended by omitting the words "Brisbane and Area" and substituting the words "South East Queensland". 6. Repeal of s. 3. Arrangement of Act. Section 3 of the Principal Act is repealed. 7. Amendment of s. 4. Meaning of terms. Section 4 of the Principal Act is amended by- (a) omitting the note appearing in and at the beginning of the section and substituting the note "Interpretation."; (b) numbering the existing provision as subsection (1); (c) omitting the definition "Advisory Committee"; (d) in the definition "Board", omitting the words "Brisbane and Area" and substituting the words "South East Queensland"; (e) in the definition "Commissioner ", omitting the words "Water Resources Administration Act 1978-1984" and substituting the words "Water Resources Act 1989-1990"; (f) inserting after the definition "dam" the following definition:- "Director-General" means the chief executive by whatever title of office the chief executive is known, of the department of government of Queensland within which this Act is
Brisbane and Area Water Board Act Amendment Act 1991, 391 No. 21 administered and includes any officer temporarily discharging the responsibilities of the chief executive;"; (g) in the definition "Local Authority", omitting the words "Joint Local Authority" and substituting the words "Joint Local Authority Board"; (h) inserting after the definition "maximum flood level" the following definition:- "member", in relation to a Local Authority, includes an alderman or councillor of the Authority;"; (i) omitting the definition "operational area" and substituting the following definition:- "operational area" means the Operational Area of South East Queensland Water Board referred to in section 6;"; (j) inserting after the definition "secretary" the following definition:- "Technical Advisory Committee" means the Technical Advisory Committee established under this Act;"; (k) adding at the end of the section the following subsections:- "(2) In this Act, a reference to a nominee of a Local Authority shall be read as a reference to the member of that Local Authority nominated in accordance with the regulations, whether or not that person was, in fact, nominated by that Local Authority. (3) While an Order in Council under section 29 (1) remains in force in respect of" any treatment works or trunk mains, a reference in section 30, 30A, 31, 38 or 39 to headworks shall be read as including a reference to those treatment works or trunk mains.". 8. Amendment of s. 5. Provisions concerning application of other enactments . Section 5 of the Principal Act is amended in subsection (2) (a) by omitting the words "the Brisbane and Area Water Board constituted under the Brisbane and Area Water Board Act 1979" and substituting the words "the Board constituted under the South East QueenslandWater Board Act1979". 9. Repeal of and new s. 6. Section 6 of the Principal Act is repealed and the following section substituted:- "6. Operational area. (1) For the purposes of this Act, there shall be an area called the "Operational Area of South East Queensland Water Board". (2) The Operational Area of South East Queensland Water Board is- (a) the area delineated on map No. M393 deposited in the Department of Lands; or (b) where that area is varied by regulations-that area as so varied.
392 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 (3) The operational area may not be varied unless- (a) each Local Authority whose Area or part of whose Area would, if the proposed variation were implemented, be included in, or excluded from, the operational area, as a result of that variation, consents to the variation; and (b) if a Ministerial Advisory Committee has been established under section 21A-the Committee approves the variation.". 10. Amendment of s. 7. Publication of operational area. Section 7 of the Principal Act is amended by omitting the words "map No. M393 referred to in section 6" and substituting the words "a map delineating the operational area". 11. Heading to Part III. The heading to Part III of the Principal Act is omitted and the following heading substituted:- "PART III-SOUTH EAST QUEENSLAND WATER BOARD". 12. Amendment of s. S . Constitution of Board . Section 8 of the Principal Act is amended in subsection (1) by omitting all words from and including the words "There shall be" to and including the words "which, by that name" and substituting the following words:- "The body corporate constituted under the Brisbane and Area Water Board Act 1979-1990 under the name and style "Brisbane and Area Water Board" is preserved, continued in existence and constituted as a body corporate under this Act under the name and style "South East Queensland Water Board" and the body corporate, by that name". 13. Repeal of ss. 9-12 and new s. 9. Sections 9, 10, 11 and 12 of the Principal Act are repealed and the following section is substituted:- "9. Members of Board . The Board consists of the following members:- (a) a Chairperson; (b) two members who are aldermen of Brisbane City Council; (c) one member who is an alderman of the Council of a City, other than Brisbane, whose Area or part of whose Area is within the operational area; (d) one member who is a councillor of the Council of a Shire whose Area or part of whose Area is within the operational area.". 14. Repeal of and new s. 13. Section 13 of the Principal Act is repealed and the following section substituted:- "13. Appointment of members of Board . (1) The members of the Board shall be appointed by the Minister by notification published in the Gazette.
Brisbane and Area Water Board Act Amendment Act 1991, 393 No. 21 (2) In appointing persons to the Board, the Minister shall- (a) for the purposes of section 9 (b)-appoint two persons who were nominated and approved, in accordance with the regulations, for appointment to the Board as the nominees of Brisbane City Council; (b) for the purposes of section 9 (c)-appoint the person selected, in accordance with the regulations, from the persons nominated, in accordance with the regulations, for appointment to the Board as the respective nominees of each of the Councils of the Cities, other than Brisbane, whose Areas or parts of whose Areas are within the operational area; and (c) for the purposes of section 9 (d)-appoint the person selected, in accordance with the regulations, from the persons nominated, in accordance with the regulations, for appointment to the Board as the respective nominees of each of the Councils of the Shires whose Areas or parts of whose Areas are within the operational area. (3) The Minister shall not appoint a nominee of a Local Authority to the Board unless the nominee is a member of that Authority. (4) Regulations made for the purposes of subsection (2) (a) may be made to apply differently in respect of each nomination.". 15. Amendment of s. 14. Term of appointment . Section 14 of the Principal Act is amended by- (a) in subsection (1), inserting after the words "first constituted" the words "after the commencement date"; (b) in subsection (3), inserting after the words "first constitution" the words "after the commencement date"; (c) adding at the end of the section the following subsection:- "(6) In this section- "commencement date" means the date of commencement of section 13 of the Brisbane and Area Water BoardAct Amendment Act 1991.". 16. Amendment of s. 15. Termination of membership of Board. Section 15 of the Principal Act is amended in subsection (3) (c) by- (a) omitting the words "being a representative of a Local Authority on the Board" and substituting the words "being a member of a Local Authority whose Area or part of whose Area is within the operational area"; (b) in subparagraph (i)- (i) omitting the words "an alderman or"; (ii) omitting the words "aldermen or"; (c) in subparagraph (ii), omitting the words "an alderman or";
394 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 (d) omitting subparagraph (iii) and substituting the following subparagraph:- "(iii) the member is removed from office as a member by the Minister;". 17. Amendment of s. 16 . Casual vacancy in membership of Board. Section 16 of the Principal Act is amended by- (a) in subsection (2), omitting the words "in accordance with section 13" and substituting the words "by the Minister by notification published in the Gazette"; _ (b) omitting subsection (3) and substituting the following subsections:- "(3) Where a casual vacancy occurs in the office of a member of the Board who was a member of a Local Authority referred to in section 9, the Minister shall, in appointing a person to that office- (a) where the office is the office of a member referred to in section 9 (b)-appoint the person nominated and approved, in accordance with the regulations, for the appointment as the nominee of Brisbane City Council; (b) where the office is the office of the member referred to in section 9 (c)-appoint the person selected, in accordance with the regulations, from the persons nominated, in accordance with the regulations, for the appointment as the respective nominees of each of the Councils of the Cities, other than Brisbane, whose Areas or parts of whose Areas are within the operational area; and (c) where the office is the office of the member referred to in section 9 (d)-appoint the person selected, in accordance with the regulations, from the persons nominated, in accordance with the regulations, for the appointment as the respective nominees of each of the Councils of the Shires whose Areas or parts of whose Areas are within the operational area. (3A) The Minister shall not appoint a nominee of a Local Authority to a casual vacancy in the office of a member of the Board unless the nominee is a member of that Authority.". 18. Amendment of s. 17. Delegate members of Board . Section 17 of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:- "(2) The nomination of a delegate member shall be made by the member for whom the delegate member is to deputise.". 19. Amendment of s. 18. Persons deemed to be members of Local Authority. Section 18 of the Principal Act is amended in paragraph (a)

Amendment of s. 19 . Chairman . Section 19 of the Principal Act is amended by omitting subsection (2) and substituting the following subsection:- "(2) A person is not eligible to be the Chairperson of the Board if the person is- (a) an officer of the public service; (b) an employee of a Local Authority; or (c) a member of a Local Authority referred to in section 21. Amendment of s. 20 . Deputy Chairman . Section 20 of the Principal Act is amended in the second paragraph of subsection (1) by omitting the words "duly nominated for appointment" and substituting the words "constituting the Board". 22. Amendment of s. 21 . Committee to advise Board . Section 21 of the Principal Act is amended by- (a) omitting the note appearing in and at the beginning of the section and substituting the note "Technical Advisory Committee."; (b) omitting subsections (1), (2), (3) and (4) and substituting the following subsections:- "(1) There is established a Technical Advisory Committee for the purpose of furnishing to the Board information and advice with respect to- (a) any matter connected with the powers or functions of the Board; and (b) any matter referred to it by the Minister or the Board. (2) The Technical Advisory Committee consists of the following members:- (a) three members nominated by the -Director-General; (b) the person for the time being holding the office of Manager , Water Supply Department , Brisbane City Council, or the person's nominee; (c) a person nominated by the Board , being a person who is an officer of a Local Authority (other than Brisbane City Council) whose Area or part of whose Area is within the operational area; (d) while the Committee is considering a matter involving the affairs of a particular Local Authority whose Area or part of whose Area is within the operational area- an officer of the Local Authority nominated by it.
396 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 (3) The members of the Technical Advisory Committee shall be appointed by the Minister. (3A) The Minister shall appoint a member referred to in subsection (2) (a) to be the Chairperson of the Technical Advisory Committee. (3B) A nominee of the person referred to in paragraph (b) of subsection (2) shall be an officer of the Department referred to in that paragraph. (3C) The appointment of a nominee under subsection (2) (b) or (c) ceases to have effect if the nominee ceases to be an officer of the relevant Department, or of the relevant Local Authority, as the case may be. ( The^T}ectc^r enera, the person referred to in subsection (2) (b) or the Board- (a) may, at any time, change any one or more of the nominees, or the nominee, of the Director-General, - person or Board, as the case may be, on the Technical Advisory Committee; (b) may appoint a person to be a delegate of one of the nominees, or of the nominee, of the Deter C¢nera1,- person or Board, as the case may be, for the time being for the purpose of attending a meeting or meetings of the Technical Advisory Committee; and (c) shall, as soon as practicable after exercising a power under this subsection, inform the Minister of the decision."; (c) in subsection (5)- (i) omitting the first paragraph and substituting the following paragraph:- "The Technical Advisory Committee shall hold such meetings as it considers necessary for the performance of its function."; (ii) inserting in the second paragraph the word "Technical" before the words "Advisory Committee"; (iii) omitting from provision (a) of the second paragraph the words "by the Board" and substituting the words "by the Minister or the Board"; (d) omitting subsections (6) and (7) and substituting the following subsection:- "(6) As soon as practicable after the Board receives a report of the Technical Advisory Committee under subsection (5), the Board shall, through its Chairperson, forward a copy of that report to the Minister.". 23. New s. 21A. The Principal Act is amended by inserting, in Division 2 of Part III, after section 21 the following section:- "21A. Ministerial Advisory Committee . (1) The Minister may, if requested by the Local Authorities, or a majority of the Local
Brisbane and Area Water Board Act Amendment Act 1991, 397 No. 21 Authorities, whose Areas or parts of whose Areas are within the operational area, establish a Ministerial Advisory Committee for the purpose of furnishing advice to the Minister with respect to- (a) the administration or operation of- (i) this Act; or (ii) any other Act that confers or imposes any powers or functions on the Board; and (b) any matter referred to the Committee by the Minister. (2) A Ministerial Advisory Committee consists of a number of members that is equal to the number of Local Authorities whose Areas or parts of whose Areas are within the operational area. (3) The members of a Ministerial Advisory Committee shall be appointed by the Minister. (4) A person is not eligible to be appointed as a member of a Ministerial Advisory Committee- (a) unless the person has been nominated for appointment by a Local Authority referred to in subsection (2) and is a member of that Authority; or (b) if the person is a member of the Board. (5) The office of a member of a Ministerial Advisory Committee becomes vacant if the member ceases to be a member of the Local Authority that nominated him or her for appointment to the Committee. (6) The Minister shall appoint- (a) one member of a Ministerial Advisory Committee to be the Chairperson of the Committee; and (b) another member of the Committee to be the Deputy Chairperson of the Committee. (7) During any period when- (a) the office of Chairperson of a Ministerial Advisory Committee is vacant; or (b) the Chairperson of a Ministerial Advisory Committee is unable to perform the duties of the office; the Deputy Chairperson shall act as Chairperson and, while so acting, the Deputy Chairperson has and may exercise all the powers, authorities, rights and duties of the Chairperson of the Committee. (8) As soon as practicable after each meeting of a Ministerial Advisory Committee, the Committee shall, through its Chairperson, furnish a report to the Minister- (a) informing the Minister of its opinion and recommendations on matters referred to it by the Minister; and
398 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 (b) if it thinks fit- (i) drawing the Minister's attention to matters that it considers relevant to the powers or functions of the Board; and (ii) informing the Minister of its recommendations as to courses of action arising in respect of such matters. (9) Except where provision is made by this section, matters relating to- (a) the terms and conditions of appointment of members of a Ministerial Advisory Committee; (b) the rights and duties of members of such a Committee; an d (c) the conduct of the business of such a Committee; may be determined by the Minister by nifi"a ion published in the G, azette . a.and, without limiting the generality of that power, the Minister may make determinations in respect of the following matters:- (d) the convening of meetings of a Ministerial Advisory Committee; (e) the termination of membership of such a Committee; (f) the appointment of persons as delegate members of the Committee to deputise for members of such a Committee.". 24. Repeal of and new s. 29. Section 29 of the Principal Act is repealed and the following section substituted:- "29. Power of Board to take over undertakings of Local Authorities . (1) Subject to this Act, the Board may- (a) assume from a Local Authority control of- (i) any headworks; and (ii) where the Governor in Council by Order in Council so directs-specified treatment works or trunk mains; in the operational area; (b) acquire from a Local Authority property used for or in connexion with- (i) any headworks; and (ii) where the Governor in Council by Order in C council- so directs-specified treatment works or trunk mains; in the operational area; and (c) assume from a Local Authority liabilities and obligations incurred by it in connexion with- (i) any headworks; and (ii) where the Governor in Council by Order in Council

(2) The powers conferred on the Board under subsection (1) may be exercised only in relation to a Local Authority whose Area or part of whose Area is within the operational area.". 25. New s. 39A. The Principal Act is amended by inserting, in Division 2 of Part IV, after section 39 the following section:- "39A. Delegation by Board. (1) The Board may, by instrument, either generally or as otherwise provided by the instrument, delegate to- (a) the Chairperson of the Board; or (b) the secretary; all or any of its powers, authorities, functions or duties, except this power of delegation. (2) A power, authority, function or duty delegated under subsection (1) shall- (a) be exercised, discharged or performed in accordance with the instrument of delegation; and (b) when exercised, discharged or performed by the delegate, be taken to have been exercised, discharged or performed by the Board. (3) A delegation by the Board under subsection (1)- (a) does not prevent the exercise, discharge or performance of the power, authority, function or duty by the Board; (b) may be made subject to such terms and conditions as the Board thinks fit, including a requirement that the delegate report to it upon the exercise, discharge or performance by the delegate of the power, authority, function or duty; and (c) may, by instrument, be varied or revoked by the Board.". 26. Amendment of s. 106 . O perational procedures for flood mitigation. Section 106 of the Principal Act is amended by- (a) in subsection (1), inserting in the first paragraph the word "Technical" before the words "Advisory Committee"; (b) in subsection (2), inserting the word "Technical" before the words "Advisory Committee". 27. Amendment of s. 116 . Validity of proceedings . Section 116 of the Principal Act is amended by omitting the words "one-half of the
400 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 total number of members for the time being required to constitute the Board" and substituting the word "two". 28. Amendment of s. 117. Disability on participation in business of Board . Section 117 of the Principal Act is amended in the second paragraph of subsection (1) by omitting the words "an alderman or". 29. Amendment of s. 132 . Obstruction of Board ' s agents. Section 132 of the Principal Act is amended by- (a) omitting the note appearing in and at the beginning of the section and substituting the note "Obstruction."; (b) inserting before the word "agent" the words "employee or". 30. Amendment of s. 133. Assault on Board ' s agents. Section 133 of the Principal Act is amended by- (a) omitting the note appearing in and at the beginning of the section and substituting the note " Assault and intimidation."; (b) inserting before the word "agent" the words "employee or". 31. Amendment of s. 134. Regulations . Section 134 of the Principal Act is amended by inserting after paragraph (e) the following paragraphs:- (ea) the nomination, approval and selection of persons for appointment to the Board; (eb) the establishment, membership, powers and functions of a committee for the purpose of approving or selecting persons for appointment to the Board; 32. Repeal of Schedule. The Schedule to the Principal Act is repealed. 33. Amendments of references to Chairman and Deputy Chairman. The Principal Act is amended as set out in the Schedule. PART III-TRANSITIONAL PROVISIONS 34. Interpretation . In this Part- "commencement date" means the date of commencement of section 12. 35. Membership of Brisbane and Area Water Board. On the commencement of section 13, the persons who, immediately before that commencement, held office as members of the Brisbane and Area Water Board cease to hold office. 36. Advisory Committee . On the commencement of section 22- (a) the Advisory Committee constituted under section 21 of the Principal Act immediately before that commencement ceases to exist;

Any manual, or any amendment of a manual, prepared under section 106 of the Principal Act and having effect immediately before the commencement of section 26 of this Act continues to have effect on and after that commencement as if it had been prepared and approved under section 106 of the Principal Act as amended by this Act. 38. References to Act. (1) A reference in any Act passed, or in any instrument or other document made, before the commencement of section 3 to the Brisbane and Area Water Board Act 1979 or to that Act as amended to any year specified in the reference is to be construed as a reference to the South East Queensland Water Board Act1979 or, as the case may be, that Act as amended to the year so specified. (2) Subsection (1) applies without prejudice to the operation of the Acts Interpretation Act 1954-1990. 39. References to Board . A reference in- (a) this Act or any other Act; (b) any Proclamation, Order in Council, regulation, by-law or other instrument made under this or any other Act; (c) any contract or agreement; or (d) any other instrument; in force immediately before the commencement date, to the Brisbane and Area Water Board is, on and after that date, to be read and construed as a reference to the South East Queensland Water Board. 40. Legal proceedings . Where, before the commencement date- (a) a cause of action by or against the Brisbane and Area Water Board had arisen but proceedings in respect of that cause of action had not been instituted before that date; or (b) proceedings by or against the Brisbane and Area Water Board had been instituted but those proceedings had not been completed before that date; proceedings in respect of the cause of action may be instituted, or the proceedings may be continued, as the case may be, by or against the South East Queensland Water Board. 41. Dealings relating to land . The Registrar of Titles or the Registrar of Dealings and any other person charged with maintaining a register of dealings relating to land vested in or held by the Brisbane and Area Water Board must, as soon as practicable after the commencement date, without further authority other than this section, alter the name as shown in that register of the registered proprietor, registered lessee,
402 Brisbane and Area Water Board Act Amendment Act 1991, No. 21 owner or occupier of land referred to in that register to the name South East Queensland Water Board. 42. Regulations . For the purpose of effecting the first constitution of the Board following the commencement of section 31 of this Act, regulations that could be made under the Principal Act as amended by this Act when all of the provisions of this Act are in force, may be validly made under the Principal Act as amended by section 31 of this Act. SCHEDULE [s. 33] AMENDMENTS OF REFERENCES TO CHAIRMAN AND DEPUTY CHAIRMAN 1. The following provisions of the Principal Act are amended by omitting the word "Chairman" (wherever occurring) and substituting the word "Chairperson" (in each case):- Sections 4 (definition), 19 (note in and at the beginning), 19(1), 20 (note in and at the beginning), 20(1) and (2), 24(2)(b) and (c), 60(1) (b), 68(3)(a), 88(2), 89(3) and (5), 92(4)(a), 110(2), 111(1) and (2), 113(2), 114, 115(2) and (3), 118, 136(5)(f) and 141(1). 2. The following provisions of the Principal Act are amended by omitting the word "chairman" (wherever occurring) and substituting the word "Chairperson" (in each case):- Sections 21(5), 24(4) and 115(4). 3. The following provisions of the Principal Act are amended by omitting the word "Deputy-Chairman" (wherever occurring) and substituting the words "Deputy Chairperson" (in each case):- Sections 110(2) and 111(1) and (2). 4. The note appearing in and at the beginning of section 118 of the Principal Act is amended by omitting the word "Chairman's" and substituting the word "Chairperson's".
