36 Brisbane and Area Water Board Act Amendment Act 1981, No. 9 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Brisbane and Area Water Board Act Amendment Act 1981. (2) The Brisbane and Area Water Board Act 1979 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Brisbane and Area Water Board Act 1979-1981. 2. Amendment of s. 4. Meaning of terms. Section 4 of the Principal Act is amended by- (a) inserting after the definition of " Chairman " the following definition- ` " Commissioner " means the Commissioner of Water Resources within the meaning of the Water Resources AdministrationAct1978;'; (b) omitting the definition of " Director "; and (c) in the definition of " Minister " omitting the words " Minister for Local Government and Main Roads or other ". 3. Amendment of s. 7. Publication of operational area. Section 7 of the Principal Act is amended by omitting the word " Director " and substituting the word " Commissioner ". 4. Amendment of s. 21. Committee to advise Board . Section 21 of the Principal Act is amended by- (a) in subsection (2) omitting paragraphs (b) and (c) and substituting the following paragraphs- (b) the Commissioner, or his nominee; (c) the person holding the office of Director of Local Government, or his nominee;"; and (b) in subsection (6) omitting the word " Director " where it twice occurs and substituting in each case the word " Commissioner ". 5. Amendment of s. 41. Procedure for obtaining consent. Section 41 of the Principal Act is amended by in subsection (1) omitting the words " Director who shall refer the matter to the Commissioner of Water Resources for investigation " and substituting the word " Commissioner ". 6. Amendment of s. 89. Audit of accounts . Section 89 of the Principal Act is amended by in subsection (4) omitting the word "Authority " and substituting the word " Board ".

Section 106 of the Principal Act is amended by omitting subsection (3). 8. Amendment of s. 109. Co - operative practice of Board and Electricity Generating Board. Section 109 of the Principal Act is amended by- (a) in subsection (3) omitting all the words following the words furnished to the " and substituting the words " Commissioner for the approval of the Minister who may approve or reject the same or recommend amendment thereof "; and (b) in subsection (6) omitting the expression " (3) " and substituting the expression " (5)
