2 Breakwater Island Casino Agreement Variation No. 347, 1993 ˙ Short title 1. This regulation may be cited as the Breakwater Island Casino Agreement Variation Regulation 1993 . ˙ Approval of proposed variation of formal agreement 2. For the purposes of section 3 of the Act, the proposed further agreement set out in the Schedule is approved.

3 Breakwater Island Casino Agreement Variation No. 347, 1993 ¡ SCHEDULE AGREEMENT section 2 THIS DEED is made the day of 1993. BETWEEN THE STATE OF QUEENSLAND (“ the State ”) AND ANZ EXECUTORS & TRUSTEE COMPANY LIMITED (A.C.N. 006 132 332) a company incorporated in the State of Victoria and having its principal place of business in the State of Queensland at 1st Floor, 307 Queen Street, Brisbane, Queensland (“ the Trustee ”) AND BRE AKWATE R ISLA ND LIMI TED (A.C.N. 010 271 691) a company incorporated in the State of Queensland and having its registered office at Ground Floor, Garden Square, 643 Kessels Road, Upper Mount Gravatt, Brisbane, Queensland (“ the Manager ”) WHEREAS A The State, the Trustee and the Manager are the parties to the formal agreement; and B The Breakwater Island Casino Agreement Act 1984 provides that the formal agreement may be varied by a further agreement between the Minister and the other parties to the formal agreement if the proposed further agreement has been approved by regulation; and C The parties to the formal agreement have agreed that the formal agreement be varied in the manner herein provided. NOW THIS DEED WITNESSES and it is hereby agreed and declared as follows— 1. This Deed of Variation is a variation to the formal agreement for the purposes of section 3 of the Breakwater Island Agreement Act 1984 .

The parties agree to amend the formal agreement by inserting after paragraph 65(d)(iii)— “ (iiia) a lease or sublease of the site for shops or commercial offices; or ”.
