BREAD INDUSTRY (AMENDMENT) ACT.

Act No. 56,1964.

An Act to make further provisions in respect of the times for the baking and delivery of bread; for this purpose to amend the Bread Industry Act, 1946-1958; and for purposes connected therewith. [Assented to, 16th December, 1964.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as follows: —

(1) This Act may be cited as the "Bread Industry (Amendment) Act, 1964".

or replacing that Act";

(2) The Bread Industry Act, 1946, as amended by subsequent Acts and by this Act, may be cited as the Bread Industry Act, 1946-1964.

  1. The Bread Industry Act, 1946-1958, is amended—

(a) by omitting from the definition of "Inspector" in! section three the words "Factories and Shops Act,:

1912, as amended by subsequent Acts" and by

inserting in lieu thereof the words "Factories, Shops and Industries Act, 1962, or any Act amending

( b ) by omit t ing f rom section four the words "o the r t h a n
P a r t I V " ;

(c)

by inserting in section five after the words "said sec t ion" the words " , o r in Schedule 1 A to this Ac t ,

as the case m a y r e q u i r e , " ;

( d )

by inser t ing in p a r a g r a p h ( b ) of section six after the words "sa id sec t ion" the words " , o r b y Schedule 1 A to this Ac t , as the case m a y r e q u i r e , " ;

( e )

( i )

by omit t ing subsect ion three of section 6 A a n d b y insert ing in l ieu thereof the following sub­ sect ion : —

( 3 ) ( a ) T h e Minis ter , whenever after the
c o m m e n c e m e n t of t h e Bread Indus t ry
( A m e n d m e n t ) Ac t , 1964 , h e varies the t imes

for c o m m e n c i n g work specified in the F i r s t Schedule to this Ac t , shall by the te rms of such

var ia t ion s tate e i t h e r —

(i)     t ha t the var ia t ion is in acco rdance wi th

p a r a g r a p h (b ) of this subsect ion, or

(ii)     t ha t the var ia t ion is in acco rdance wi th

p a r a g r a p h (c) of this subsect ion.
( b ) W h e r e the var ia t ion was m a d e
before such c o m m e n c e m e n t or is s ta ted to b e
in acco rdance wi th this p a r a g r a p h , such var ia ­

t ion shall b e as follows, tha t is to say : —

(i) t he figures, symbols a n d let ters " 3 . 3 0
a .m . " shall b e subst i tuted for the
figures, symbols a n d letters " 4 . 3 0 a .m."
wherever occur r ing in the said
Schedule ;
(ii)

(ii)    the figures, symbols and letters "4.30

a .m." shall b e subst i tuted for t h e
figures, symbols a n d letters " 5 . 3 0 a .m."
wherever occur r ing in the said

Schedu le ;

(i i i)     the figure, symbols a n d letters " 2 a .m." shall b e subst i tuted for the figure, symbols a n d letters " 4 a .m." wherever occur r ing in the said Schedule .

( c ) W h e r e the var ia t ion is s ta ted to
be in acco rdance wi th this pa r ag raph , such

var ia t ion shall consist in the subst i tut ion for the t imes for commenc ing w o r k specified in the said Schedule of those specified in

Schedule 1 A to this A c t .

(ii)    by inserting next after subparagraph (i) of

p a r a g r a p h ( a ) of subsect ion four of the same
section the following new s u b p a r a g r a p h :
( ia) tha t a b r e a d manufac tu re r shall in

respect of his employees so engaged in such bakehouse , o r in respect of such class o r classes of those employees as the Minis te r m a y specify, observe such of the te rms of a n a w a r d as t h e

Minis te r m a y specify. Such a condi ­

t ion m a y be imposed whe ther o r no t the award would b u t for the opera t ion of this section b e b inding o n the b r e a d

manufac tu re r in respect of any such
e m p l o y e e ;
(iii) by insert ing a t the end of the same p a r a g r a p h
the following proviso : —
Prov ided tha t no th ing in subpa rag raph ( ia)
of this p a r a g r a p h shall affect the obl igat ion of

a b r e a d manufac tu re r to observe t h e te rms of an award whe the r such terms a re the subject of a condi t ion u n d e r the said subpa rag raph or n o t ;

( i v )

( iv) by insert ing in p a r a g r a p h ( b ) of the same
subsect ion after the symbols and n u m e r a l
" ( i ) " where firstly occur r ing the word ,
symbols , n u m e r a l a n d let ter " o r ( i a ) " ;
( v ) b y inser t ing in s u b p a r a g r a p h (i) of the same
p a r a g r a p h after the words " r a t e o r ra tes of
w a g e s " where firstly occur r ing the words " o r
of any o ther a m o u n t s " ;
(vi ) b y inser t ing in the same s u b p a r a g r a p h after
the words " r a t e o r rates of w a g e s " where
secondly occur r ing the words " o r o ther
a m o u n t s " ;
(vii) b y omit t ing from the same subpa rag raph t h e
w o r d " lowes t " wherever o c c u r r i n g ;
(viii) by omit t ing s u b p a r a g r a p h (ii) of the same
p a r a g r a p h a n d by inser t ing in lieu thereof the
following s u b p a r a g r a p h :

(ii)    in respect of any employee, the condi­ t ion, in so far as it relates to such addi t iona l r a t e o r ra tes of wages o r o the r amoun t s , shall if o r to the extent to wh ich it is no t a t e r m of the a w a r d appl icable t o his employmen t b y v i r tue of the said Ac t , as so amended , b e deemed , for t h e purposes of sect ion ninety-two of t h e said A c t , as so a m e n d e d , to b e a t e rm of the last

men t ioned a w a r d ;
( ix) by insert ing in s u b p a r a g r a p h (iii) of the same

p a r a g r a p h after the figures " 1 9 5 5 , " the words " o r any A c t amend ing or replac ing the said A c t s " ;

(x) by inserting at the end of subsection five of

the same section the words " : P rov ided tha t where any such failure t o comply is also a con t raven t ion of o r failure t o observe an award , proceedings in respect of the subject

m a t t e r

mat te r of such offence m a y b e t aken ei ther
unde r this A c t o r u n d e r the Indust r ia l Arb i t ra ­

t ion Act , 1940 , as a m e n d e d by subsequent Ac t s , bu t the offender shall no t b e l iable t o a pena l ty unde r b o t h this A c t and the said Ac t , as so amended , in respect thereof ." ;

(f) by inserting at the end of section seven the follow­
ing n e w s u b s e c t i o n :
( 2 ) W h e r e b u t for the ope ra t ion of this sub­
sect ion there wou ld b e m o r e t han th ree successive
days o n which the m a k i n g or b a k i n g of b r e a d b y

b r e a d manufac tu re r s a n d employees for t r a d e o r sale would be con t ra ry to any of the provisions of this Ac t , the Minis ter m a y exempt b r e a d manufac ­ turers and employees from such provis ions t o the extent necessary to enable such m a k i n g o r b a k i n g to b e carr ied ou t o n any o n e of those days as specified in the exempt ion , subject t o such condi ­

t ions as the Minis ter m a y de te rmine .

(g)

by omit t ing from p a r a g r a p h (c) of the proviso to subsect ion one of section eight the words " o r by S t a t u t e " ;

( h )
( i ) b y omi t t ing f rom subsect ion th ree of sect ion
eleven the words "pol ice o r " ;
(ii) by omi t t ing from subsect ion four of t h e same
sect ion the words "pol ice o r " ;

( i )    b y inser t ing next after the Fi rs t Schedule the follow­
