AN ACT to amend sections three, twelve, fifteen and sixteen of the Bread Act, 1903-1938, and to impose certain restrictions on the sale and delivery of bread ; and for incidental purposes.

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis-

lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows

Short title.

(1) This Act may be cited as the Bread Act Amendment Act, 1947, and shall be read as one with the Bread Act, 1903-1938 (No. 5 of 1903, as reprinted in the Appendix to the Sessional Volume of the Statutes for the year 1937-1938, and amended by Act No. 44 of 1938),

Citation.

hereinafter referred to as the principal Act.

(2) The principal Act as amended by this Act may be cited as the Bread Act, 1903-1947.

Amendment

of s. 3.

2.

Section three of the principal Act is amended by

deleting the definition of "Baker's holiday" and inserting

in lieu thereof the following:—

"Baker's holiday" means any day which is, by the terms of any relevant industrial award or agree- ment which has been made a common rule relat- ing to the bread industry for the time being in force under the provisions of the Industrial Arbitration Act, 1912-1941, to be regarded as a baker's holiday.

3. Section twelve of the principal Act is amended as it:tent

follows :-

(a)

by deleting subsection four and inserting in lieu

thereof the subsection following :—

(4) Bread shall be made or baked for sale only during the hours and on the days specified in any industrial award or agree- ment for the time being in force under the provisions of the Industrial Arbitra- tion Act, 1912-1941, and applying to the baking of bread in the relevant area.

(b)

by inserting at the commencement of subsection (5) the words "Vienna bread shall be made or baked for sale only during the hours and on the days specified in any industrial award or agreement for the time being in force under the provisions of the Industrial Arbitra- tion Act, 1912-1941 and applying to the baking of Vienna bread in the relevant area, but whilst not so specified in relation to the relevant area."

(c)

by deleting paragraph (b) of subsection (6).

4. A section is inserted in the principal Act after New

section twelve as follows :—

12A. Within that portion of the State referred to in subsection (1) of section twelve of this Act no bread or Vienna bread shall be sold or delivered or offered or exposed for sale within the three hours next following the time specified for the commencement of baking operations in the industrial award or agreement for the time being in force under the provisions of the Industrial Arbitration Act, 1912-1941, and applying to the baking of bread or Vienna bread, as the case may be, in the relevant area.

5. Section fifteen of the principal Act is amended as Amendment

follows :—

(a)

By inserting in subsection (1) after the words "pay on" in line one of paragraph (a) the words "the day observed as"; and

(b)

by deleting paragraph (b) of subsection (1).

Repeal of

6. Section sixteen of the principal Act is repealed.
