BREAD ACT 1969—REGULATION
(Bread Regulation 1992)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Bread Act 1969, has been pleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Bread Regulation 1992.
Commencement
2. This Regulation commences on 1st September, 1992.
Definitions
3. In this Regulation:
“Director-General” means the Director-General of the Department of
Industrial Relations, Employment, Training and Further Education;
“the Act” means the Bread Act 1969.
Licence application and renewal fee
4. For the purposes of section 12 (3) of the Act, the prescribed
application fee for a licence, or a renewal of a licence, is $20.
Trade training
5. For the purposes of section 13 (1) of the Act, the prescribed course
of training is:
1992—No. 472
(a)
an apprenticeship in bread manufacturing completed in New South Wales; or
(b)
experience as an operative baker in one or more bakehouses in New South Wales, otherwise than as an apprentice, for a period or periods totalling not less than 4 years; or
(c)
experience in bread manufacturing, elsewhere than in New South Wales, for such period (not less than 4 years) and in such capacity as the Director-General considers satisfactory.
Trade test
6. For the purposes of section 13 (1) of the Act, the prescribed examination is the trade test conducted by the Technical and Further Education Commission covering subjects in the Bread Manufacture trade course.
Certificate application fee
7. For the purposes of section 13 (3) of the Act, the prescribed application fee for a certificate is $25.
Certificate to be exhibited
8. (1) The holder of an operative baker’s certificate must make the certificate available to any licensed bread manufacturer in whose bakehouse the holder works as an operative baker.
(2) The licensed bread manufacturer must exhibit the certificate conspicuously in the bakehouse while the operative baker is working there and must return the certificate to the operative baker when the operative baker ceases to work there.
Maximum penalty: $40.
Repeal
9. The Bread Manufacture (Licensing) Regulation is repealed.

EXPLANATORY NOTE
The purpose of this Regulation is to repeal and replace the Bread Manufacture (Licensing) Regulation. The new Regulation makes provision under the Bread Act 1969 as to the following matters:
• bread manufacturer’s licence application and renewal fees;
• the trade training and testing of an applicant for an operative baker’s
certificate;
• operative baker's certificate application fees;
• the requirement to exhibit certhficates in bakehouses.
This Regulation is made in connection with the staged repeal of subordinate
legislation under Part 3 of the Subordinate Legislation Act 1989.
