Branch v Commissioner of Police
[2019] HCASL 131
BRANCH
v
COMMISSIONER OF POLICE
[2019] HCASL 131
B12/2019
The applicant requires an extension of time within which to seek special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Queensland (Holmes CJ, Philippides and McMurdo JJA), which refused the applicant leave to appeal from the dismissal by the District Court of Queensland (Judge Robertson) of the applicant's appeal against conviction by the Magistrates Court at Richlands (Magistrate Simpson) of an offence of "edge filtering" contrary to s 151B(2) of the Transport Operations (Road Use Management – Road Rules) Regulation 2009 (Qld).
The applicant identifies no question of principle which it would be in the interests of justice for this Court to consider and thus it would be futile to grant the extension that is sought. An appeal to this Court would enjoy no prospect of success.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
