Industrial action related workplace determination.
[1] The Full Bench issued a decision in this matter on 22 May 2020 which set out our determination of the issues in dispute. A draft determination to give effect to our decision was provided to the parties together with the decision. The parties were directed to confer on the content of the draft determination and to identify any agreed changes by 3 June 2020. Upon the request of parties, the Full Bench agreed to an extension of this period to 5 June 2020.
[2] We received submissions from BP Refinery (Kwinana) Pty Ltd (BP) and the Australian Workers’ Union (AWU). A number of errors and other matters requiring amendment were identified by the parties. They were all uncontroversial, and the required amendments will be made.
[3] Initially, the parties were not in agreement in relation to clause 8.6(b) in the draft determination. Accordingly, the Full Bench invited parties to make further submissions in relation to the appropriate wording of this clause. However, on 15 June 2020, the parties advised that they had resolved the wording in relation to clause 8.6(b).
[4] The Workplace Determination we make will be issued in conjunction with this decision.
