Act No. 45, 1968.

An Act to alter the name of the Corporation constituted by the Boy Scouts Association— New South Wales Branch Incorporation Act, 1928; for this and other purposes to amend that Act; and for purposes connected

therewith. [Assented to, 5th December, 1968.]

1 . (1) This Act may be cited as the "Boy Scouts

Association—New South Wales Branch Incorporation
(Amendment) Act, 1968".

D E it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in

Parliament assembled, and by the authority of the same, as

follows: —

(2) The Boy Scouts Association—New South Wales Branch Incorporation Act, 1928, as amended by the Decimal Currency Act, 1965, and this Act, may be cited as the Australian Boy Scouts Association—New South Wales Branch Incorporation Act, 1928-1968.

2. The Boy Scouts Association—New South Wales Branch Incorporation Act, 1928, as subsequently amended, is amended by inserting next after section four the following new section :—

4A. (1) As from the commencement of the Boy

Scouts Association—New South Wales Branch Incor­

poration (Amendment) Act, 1968—

(a)

the name of the Corporation constituted by section three of this Act shall be "The Australian Boy Scouts Association, New South Wales Branch";

(b)

a reference in this or any other Act or any by-law, regulation, ordinance or any other instru­ ment or document whatsoever, of the same or a different kind or nature, to The Boy Scouts Association, New South Wales Branch shall be read and construed as a reference to The Aus­ tralian Boy Scouts Association, New South Wales

Branch.

(2) Nothing contained in the Boy Scouts Association—New South Wales Branch Incorporation (Amendment) Act, 1968, shall prejudice or affect in any way the continuity of the Corporation but the same shall continue notwithstanding the provisions of the said Act.

(3)

(3 ) The alteration of name effected by subsection one of this section shall not affect any property, powers, rights, authorities, duties, functions, liabilities or obliga­ tions of the Corporation, or render defective any legal or other proceedings instituted by or against the said Corporation.

Any legal or other proceedings may be continued or commenced by or against the Corporation by the name of The Australian Boy Scouts Association, New South Wales Branch, that might have been continued or com­ menced by or against the Corporation by the name of The Boy Scouts Association, New South Wales Branch.
