v

JUDICIAL COMMISSION OF NSW

[2022] HCASL 66
S14/2022
S15/2022

  1. The applicant seeks special leave to appeal from two related decisions of the Court of Appeal of the Supreme Court of New South Wales (Macfarlan and McCallum JJA).

  2. In S14/2022, the applicant seeks special leave to appeal from the decision of the Court of Appeal dismissing the applicant's notice of appeal as incompetent and refusing the applicant leave to appeal from a decision of the Supreme Court of New South Wales (N Adams J).  Her Honour summarily dismissed the applicant's amended summons seeking judicial review of a decision of the respondent summarily dismissing the applicant's complaint about the conduct of a trial judge in proceedings instituted by the applicant in the Equity Division of the Supreme Court.  The application concerns a matter of practice and procedure.  The applicant identifies no question of principle which it would be in the interests of justice for this Court to consider.  An appeal to this Court would have no prospect of success.

  3. In S15/2022, the applicant seeks special leave to appeal from the decision of the Court of Appeal dismissing the applicant's notice of appeal as incompetent and refusing the applicant leave to appeal from another decision of the Supreme Court of New South Wales (N Adams J).  Her Honour summarily dismissed a further amended summons filed by the applicant seeking judicial review of a decision of the respondent summarily dismissing the applicant's complaint about the conduct of a different trial judge in earlier proceedings instituted by the applicant in relation to his mother's estate.  The application concerns a matter of practice and procedure.  The applicant identifies no question of principle which it would be in the interests of justice for this Court to consider.  An appeal to this Court would have no prospect of success.

  4. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the applications.
