CaseChat Overview and Summary
The central legal issues that the Commission had to determine were whether the agreement met the requirements of section 234 of the Act and whether it contained the necessary good faith bargaining provisions as stipulated in section 177. Additionally, the Commission needed to assess whether the agreement satisfied the criteria for being considered a simplified procedure agreement under section 233 of the Act.
The FWC considered the submissions from both parties and examined the content of the agreement. The Commission noted that the agreement had been developed through a process of good faith bargaining, as evidenced by the employer’s willingness to engage with the employees' representatives. The terms of the agreement were found to be fair and reasonable, and they complied with the statutory requirements for enterprise agreements. The FWC concluded that the agreement met all the necessary criteria for approval, including the good faith bargaining provisions and the simplified procedure requirements. The Commission approved the Bounceinc Enterprise Agreement 2021, allowing it to take effect as intended.
