In P8/2020, the applicant seeks leave to appeal from the judgment and orders of Nettle J given and made on 22 November 2019 ("the Nettle J Judgment") the effect of which was to dismiss the applicant's applications, among other things, for constitutional writs. In P9/2020, the applicant sought to file a notice of appeal from the Nettle J Judgment accompanied by a summons seeking an order to enlarge time for the filing of that appeal. The applicant requires extensions of time for both the application for leave to appeal and the notice of appeal but there is nothing to be gained by granting the extensions. An appeal to this Court would enjoy no prospect of success.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application for leave to appeal in P8/2020 with costs. Pursuant to r 13.03.1 of the High Court Rules, we direct that the summons in P9/2020 be determined without listing it for hearing and direct the Registrar to draw up, sign and seal an order dismissing the summons with costs.
