Borrowing and Investment Powers (Authority) Amendment Regulations 2024

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Borrowing and Investment Powers (Authority) Regulations 2022—

(a)to prescribe SEC Energy Pty Ltd, SEC Infrastructure Pty Ltd and SEC Victoria Pty Ltd for the purposes of the definition of authority in section 3(1) of the Borrowing and Investment Powers Act 1987; and

(b)to prescribe sections of the Borrowing and Investment Powers Act 1987 that apply to those authorities; and

(c)to revoke references to the State Electricity Commission of Victoria, which was abolished by the State Electricity Commission Amendment Act 2024.

2Authorising provision

These Regulations are made under section 31 of the Borrowing and Investment Powers Act1987.

3Schedule 1—Authorities and sections specified as applying to them

(1)After item 218 of Schedule 1 to the Borrowing and Investment Powers (Authority) Regulations 2022[1] insert

"218A. SEC Energy Pty Ltd (ACN 670 408 134) 8, 10, 11, 13, 14, 15
218B. SEC Infrastructure Pty Ltd (ACN 670 408 125) 8, 10, 11, 13, 14, 15
218C. SEC Victoria Pty Ltd (ACN 670 408 116) 8, 10, 11, 13, 14, 15".

(2)Item 219 of Schedule 1 to the Borrowing and Investment Powers (Authority) Regulations 2022 is revoked.
