An Act to transfer a portion of the Borough of

Randwick to the Borough of Paddington.

WH E R E A S the land described in the Schedule to this A c t now forms part of the Borough of Randwick A n d Avhereas the	Boroughs of Randwick and Paddington and the ratepayers within the
area described in the said Schedule arc desirous that the said area
shall be severed from the Borough of Randwick and added to and included within the boundaries of the Borough of Paddington A n d Avhereas it is for the interest of the said boroughs and also of the said ratepayers that such area should be so scA'ered and added and that the powers rights and liabilities hereinafter set forth should be granted conferred and imposed Be it therefore enacted b y the Queen's Mos t Excel lent Majesty by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of N e w South Wales in Parliament assembled and b y the authority of the same as follows : —
1. P r o m and after the passing of this A c t the area of land described in the Schedule to this A c t shall be severed from the Borough of Randwick and be added to and form part of the Borough of Pad­ dington and shall be included within the Upper W a r d o f the said Borough of Paddington as fully and effectually as if the said area had originally formed part of the said ward.
2. A l l acts matters and things done b y for or on behalf of the Borough of Randwick before the passing of this A c t in respect of the valuing assessing and rating of ratable property W ithin the said
area for the municipal year one thousand eight hundred and eighty-
four shall have the same force effect and operation as if the same had been done by for or on behalf of the Borough of Paddington in respect of lands Within the boundaries of the Borough of Paddington and

and all rates and taxes which may before the passing of this A c t have been imposed b y the Borough of Bandwick or the Municipal Council thereof upon the ratable property within the said area for the said municipal year one thousand eight hundred and eighty-four may be recovered and payment thereof enforced b y or on behalf of and to the Borough o f Paddington or the Munic ipa l Council thereof in the same manner and as fully as if such rates and taxes had been imposed by the Borough of Paddington or the Municipal Council thereof in respect of ratable property within the Borough of Paddington Provided that if before the passing of this A c t such rates and taxes or any portion thereof shall have been paid to the Municipal Council of the Borough

of B a n d w i c k the amounts so paid shall be forthwith paid to the
Borough of Paddington and may be recovered as money had and received to the use of the Borough of Paddington,
3. I t shall be lawful for the Municipal Council for the time being of the Borough of Paddington to pay out of the moneys of such borough the sum of five hundred pounds for the redemption of deben­

tures to that amount being a portion of certain debentures representing

the sum of two thousand live hundred pounds now outstanding issued
b y the Borough of Bandwick and redeemable in the month of October
in the year one thousand eight hundred and eighty-eight and in the meantime and until such debentures to the value o f five hundred pounds shall be redeemed to pay to the person or persons who for the t ime being shall be entitled to receive the same the interest payable in respect of such last-mentioned debentures from the first Tuesday in February in the year one thousand eight hundred and eighty-four

And in case of default shall be made in payment by the Borough of

Paddington of the said sum of five hundred pounds or the said interest at the respective times at which the same shall become payable it shall be lawful for the Borough of Bandwick to recover and enforce payment thereof from time to t ime from the Borough of Paddington as money payable b y the Borough of Paddington to the Borough of Bandwick b y virtue of this A c t .

4. Noth ing herein contained shall affect any acts done or rights
or liabilities accrued incurred or imposed b y or against the Borough of

Randwick or any person or persons in respect of any act matter or thing done or commenced to he done before the passing of this A c t and all rates and taxes imposed or payable in respect of the ratable property within the area described in the Schedule to this A c t for the municipal year one thousand eight hundred and eighty-three and pre­

vious years may be recovered and payment thereof enforced b y or on behalf of the said Borough of Bandwick as fully and in the same
manner as if this A c t had 2101 been passed.

5. This A c t may be cited as the " Boroughs of R a n d w i c k and

Paddington A c t of 1884 ."

SCHEDULE.

All that piece or parcel of land situate lying and being in the parish of Alex­

andria in the County of Cumberland Colony of New South Wales being portion of the Borough of Bandwick to be ceded to the Borough of Paddington Commencing at a point at the south-west corner of Gordon's grant and bounded on the north by that grant bearing east to the south-east corner thereof being part of the present southern boundary of the Borough of Paddington thence north-easterly to the Old South Head

Road opposite the centre of the Point Piper Road thence along the Old South Head
Road south-easterly to that point of the south side of Old South Head Road where the boundary of the City of Sydney intersects that road being near the eastern boundary of St. Matthias' Church land" thence by the said boundary of the City of Sydney along the north side of Park Road to the centre of Gordon-street thence along the centre of Gordon-street north-westerly to the centre of Leinster-street and along the centre of

that street to Bent-street and thence northerly to the point of commencement.
