1. I t shall be lawful for t he said Borough Council of t h e City of Newcas t le to g ran t from t ime to t ime leases of t h e whole or a n y par t of t he aforesaid propert ies and to improve the same as t h e Counci l m a y direct Provided tha t t he said propert ies shall be le t by publ ic competition

been dedicated for publ ic purposes and t h e Borough Council

t h e power of t h e said Borough Counci l to g ran t leases of or improve the various proper t ies and it is expedient to r emove such doubts Be i t

therefore enacted by the Queen ' s Mos t Exce l l en t Majes ty by a n d w i t h

t h e advice and consent of the Legislat ive Counci l a n d Legis la t ive

Assembly of N e w South W a l e s in Pa r l i amen t assembled a n d by t h e

au thor i ty of t h e same as follows :—

compet i t ion by way of auc t ion or tender and no lease shall be g ran ted for any t e r m exceeding twenty-one years and t h a t a reasonable year ly r en t be reserved to t he Council dur ing t h e cur rency of the lease and all such leases shall conta in t h e usua l a n d ord inary covenants con­ ditions and provisoes.

2. T h a t all leases or le t t ings heretofore g ran ted or made or pur ­ por t ing to be g ran ted or made by the said Borough Council shall be a n d are hereby declared good a n d valid leases or le t t ings of t he said lands .
3. Al l moneys ar is ing from the said leases or hereafter to become payable to t h e said Council on account therefor or ar is ing out of t he said propert ies shall be paid to t h e Treasurer of t he Munic i ­ pa l i ty of Newcas t le and shal l be placed by h i m to t he " General Accoun t " of t h e said Munic ipa l i ty for Munic ipa l purposes and used as general r evenue of the said Munic ipa l i ty and all moneys heretofore received by way of ren t s for t h e said propert ies and now in t h e hands of t he said Counci l shal l be paid and appropr ia ted in l ike m a n n e r as moneys received by v i r tue of this Act .

4. This A c t may be styled and cited as t he " Borough of

Newcastle Leas ing and Improv ing Ac t of 1 8 8 1 . "
