I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Boorowa Local Environmental Plan 2012 (Amendment No 2).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land identified as “Drinking Water Catchment” on the Boorowa

Local Environmental Plan 2012 Drinking Water Catchment Map.

[1]      Clause 6.5 Riparian land and watercourses

Omit “identified” from clause 6.5 (2) (a). Insert instead “land identified”.

Insert after clause 6.5:

6.5A

Protection of water quality in drinking water catchments

(1)

The objective of this clause is to protect and maintain water quality in drinking

water catchments.

(2)

This clause applies to land identified as “Drinking Water Catchment” on the

Drinking Water Catchment Map.

(3)

Before determining a development application for development on land to which this clause applies, the consent authority must consider the following:

(a)

whether or not the development is likely to have any adverse impact on the water quality in the drinking water catchment,

(b)

the impact of any on-site use, storage or disposal of waste water or solid waste,

(c)

any appropriate measures proposed to avoid, minimise or mitigate the adverse impacts of the development.

(4)

Development consent must not be granted to development on land to which this clause applies unless the consent authority is satisfied that the development is designed, sited and will be managed to avoid any significant adverse impact on water quality in the drinking water catchment.

[3]      Schedule 2 Exempt development

Omit all of the matter relating to “Signage” and “Tennis courts”.

Insert in alphabetical order:

Drinking Water Catchment Map means the Boorowa Local Environmental

Plan 2012 Drinking Water Catchment Map.
