These are appllcatlcns by meniF3ers, the General Secretary

and the ASSlStZnt General Secretary, of the Federated

Licjuor and Allled Industries lmployees Llnion of Australia

("the Union"). They are brought under the conclllation &

Arbitration Act, 1904 ("the Act").

In the first, N.S.W. 21 of 1978, an order is sought that rule ll(g) in the form in whlch it appeared at the time of the making of the Order Nisl should be disallowed as belng

in disconformlty wlth s.140 of the Act.

Tn the second

matter, V. 36 of 1978, orders are sought under s.141 that by treatlng as null and void and of no effect purported

the respondents, members of the Federal councll of the

resolutions of the Fedsral Council In November, 1970

amending rule ll(g) and rule 16. A second order sought

was that the respondents should perform and observe the

rules of the organization by acting bona fide in consid-

ering proposed amendnents to the rules. The claim for

thls second order :?as however abazdoned.

In additlon in these second proceedings an order was socqht against the rinion that rule ll(cj) and ruie 16(10) be dlsal- lowed as contravening s.140(1) of the Act. A further order was sought declaring that t.hc rules of the Unlon generally

contravene or alternatively that rule 13(a) in particular

contravenes s.140(1) by faillrg to provlde for the control

of

Councll meetlng.

It is obvious that the rule change 1s

to be dealt wlth at a Councll meetlng.

Rulc 25 provides

a set of rules of debate at councll meetings with prov?-slons

about the movlng and seconding of resolutions, the order of

debate, the length of speeches and the llke.

Provlslon is

also made llmitlng the manner in which matters declded may

come agaln before the council meetlng.

I think it quite cle~r that the rules cor.terrp:ate and show the intention of the Unlon that the rules of debate should apply at councll meetlngs deallnq with amendments to rules

as well as when dealing wlth any other matters.
