Boating (Whyalla Zoning) Regulations 1991

Citation

1. These regulations may be cited as the Boating (Whyalla Zoning) Regulations 1991.

Interpretation

2. In these regulations—

"controlled area 1" means that portion of the waters of the sea at Whyalla delineated on the

plan in the schedule as controlled area 1:

"controlled area 2" means that portion of the waters of the sea at Whyalla delineated on the

plan in the schedule as controlled area 2:

"controlled area 3" means that portion of the waters of the sea at Whyalla delineated on the

plan in the schedule as controlled area 3.

Note: For definition of divisional penalties (and divisional expiation fees) see Appendix.

Motor boats prohibited in controlled areas 1 and 3

3. A person who—

(a)

takes a motor boat into controlled area 1 or controlled area 3;

or

(b)

causes or permits a motor boat to enter controlled area 1 or controlled area 3,

is guilty of an offence.

Penalty: Division 10 fine.

Speed limit in controlled area 2

4. A person who, within controlled area 2—

(a)

operates a vessel at a speed exceeding eight kilometres per hour;

or

(b)

engages in water skiing, aquaplaning or is towed in any other manner, where the vessel by which he or she is towed is operated at a speed exceeding eight kilometres per hour,

is guilty of an offence.

Penalty: Division 10 fine.
