Citation

1. These regulations may be cited as the Boating (Mannum Zoning) Regulations, 1990.

Interpretation

2. In these regulations—

"controlled area No. 1" means that portion of the River Murray at Mannum bounded as

follows:

(a)

on the south west, by an imaginary straight line from the edge of the water for a distance of 16 metres in a south easterly direction parallel to and at a perpendicular distance of 52 metres north east of the imaginary prolongation of the south western boundary of Section 906 Hundred of Finniss;

(b)

on the north east, by an imaginary straight line from the edge of the water for a distance of 12 metres in a south easterly direction parallel to and at a perpendicular distance of 77 metres north east of the imaginary prolongation of the south western boundary of Section 906 Hundred of Finniss;

(c)

on the south east, by an imaginary straight line joining the southern extremities of the south western and north eastern boundaries;

and

(d)

on the north west, by the edge of the water:

"controlled area No. 2" means that portion of the River Murray at Mannum bounded as

follows:

(a)

on the south west, by an imaginary straight line in a south easterly direction from the prescribed base line parallel to and at a perpendicular distance of 85 metres south west of the imaginary prolongation of the south western boundary of Allotment 10 in Filed Plan 21817 Hundred of Finniss for a distance of seven metres perpendicular to the prescribed base line;

(b)

on the north east, by an imaginary straight line in a south easterly direction from the prescribed base line parallel to and at a perpendicular distance of 45 metres south west of the imaginary prolongation of the south western boundary of Allotment 10 in Filed Plan 21817 Hundred of Finniss for a distance of seven metres perpendicular to the prescribed base line;

(c)

on the south east, by an imaginary straight line joining the southern extremities of the south western and north eastern boundaries;

and

(d)

on the north west, by the edge of the water:

"controlled area No. 3" means that portion of the waters of the River Murray at Mannum

delineated in bold on the plan in the schedule as controlled area No. 3:

"prescribed base line" means the imaginary straight line drawn through the two most north

western points of the edge of the River Murray at Mannum that occur in Parts 9 to 11

inclusive of Deposited Plan No. 1091 Hundred of Finniss.

Activities prohibited in controlled areas No. 2 and No. 3

3. A person who—

(a)

takes a vessel, or a water ski, surfboard or other similar device, into controlled area No. 1 or controlled area No. 2;

or

(b)

causes or permits a vessel, or a water ski, surfboard or other similar device, to enter controlled area No. 1 or controlled area No. 2,

is guilty of an offence.

Penalty: Division 10 fine.

Speed limit in controlled area No. 3

4. A person who, within controlled area No. 3—

(a)

operates a vessel at a speed exceeding eight kilometres per hour;

or

(b)

engages in water-skiing, aquaplaning or is towed in any other manner at a speed exceeding eight kilometres per hour,

is guilty of an offence.

Penalty: Division 10 fine.
