2 Boating Facilities No. 137, 1992 ˙ Short title 1. This order in council may be cited as the Boating Facilities Order 1992 . ˙ Commencement 2. This order in council commences on 1 July 1992. ˙ Definitions 3. In this order in council— “vessel’s length” means the distance in metres measured in the fore and aft line from the fore part of the hull to the after part of the hull, taken at the upper side of the uppermost weathertight deck, or in the case of an open vessel, at the height of the gunwale. ˙ Vessels subject to fee 4. For the purposes of section 140A of the Act, the boating facilities fee must be paid by the owner of a vessel required to be registered under— (a) the Private Pleasure Vessels Regulation 1984 ; or (b) Part 3 or 4 of the Motor Boat and Motor Vessel Regulation 1975 ; or (c) the Marine (Registration, Survey, Equipment and Load Line) Regulation 1987 . ˙ Amount of fee 5. Subject to sections 6 and 7, the boating facilities fee is— (a) if the vessel’s length does not exceed 10 m—$6.30 for each metre, or part of a metre, of the vessel’s length; or (b) if the vessel’s length exceeds 10 m but not 35 m—$63.00 plus $10.40 for each metre, or part of a metre, by which the vessel’s length exceeds 10 m; or (c) if the vessel’s length exceeds 35 m—$323.40.
3 Boating Facilities No. 137, 1992 ˙ Pensioner’s rebate 6.(1) A person who receives a totally and permanently incapacitated war pension is entitled to a full rebate of the boating facilities fee for 1 vessel. (2) A person who receives a full— (a) disability support pension; or (b) age pension; or (c) widow’s pension; or (d) wife’s pension; or (e) blind pension; or (f) sole parent’s benefit; or (g) service or general rate disability pension; is entitled to a rebate of 50% of the boating facilities fee for 1 vessel. ˙ Waiver of fee by Minister 7. The Minister may waive the whole, or any part, of the boating facilities fee payable for a vessel if satisfied that the vessel forms part of a fleet of vessels that— (a) are located at, and operating from, a set location; and (b) are required to be registered under Part 3 or 4 of the Motor Boat and Motor Vessel Regulation 1975 ; and (c) do not use any public boating facilities. ˙ Repeal 8. The order in council published in the Gazette on 29 June 1991 at page 1177 is repealed.
