AN ACT to amend the Boat Licensing Act,

1878.

Section seven of the principal Act is amended by omitting the words " as the case may be," and by adding to the section the words " and in their discretion to cancel or revoke any license granted under this Act."

Sec. 7.

Amendment of

Section eight of the principal Act is amended by insert- ing after the words " license, the fee," in line fourteen, the words " prescribed by regulations made under this Act, and until such regulations are made, the license fee."

8. Sections thirteen and fourteen of the principal Act are

repealed.

Section nineteen of the principal Act is amended by omitting all the words after the word "offence" to the end of the section, and inserting in place thereof the words " shall be liable to a fine not exceeding twenty pounds or to imprisonment with or without hard labour for a term not exceeding six months."

Every licensing board is hereby authorised to inquire into licensed master or coxswain, and may, .on any such charge being proved to their satisfaction, suspend or cancel the cer- tificate held by such master or coxswain.

Every licensing board may make regulations :—

( I. )

For the licensing of all steamers, vessels, and boats

employed. in carrying goods or passengers or goods

and passengers for reward or plying for hire or

held for hire, including all steam or other ferry boats, tugs, ballast boats, tank boats, cargo boats, and lighters ;

(2.) Prohibiting the use of any steamer, vessel, or boat for carrying goods or passengers or goods and passengers for reward or .in plying for hire, or the holding of any steamer, vessel, or boat for hire unless licensed under this Act ;

(3.)

Regulating the carriage by lighters and other vessels,

steamers, or boats of explosives, ballast, offal, refuse,

or water ;

(4•)

Prescribing the qualifications of persons applying for

licenses as masters or coxswains ;

(5-)

For the manning of all steamers, boats, and vessels

engaged in any kind of licensed trade whatsoever

under this Act ;

(6.) Prescribing the life-saving appliances (including boats)

to be carried by every steamer, vessel, or boat,

and the waters in which such appliances shall be

carried, and for the exemption of steamers, vessels,

or boats from carrying all or any such appliances ;

(7.) Prohibiting the letting for hire, or the use of any steamer, vessel, or boat unless the prescribed life- saving appliances are carried ;

(8.) Prescribing the structural design of all licensed steamers, vessels, or boats as regards th.e preservation of life and goods, and for the safety of such steamers, vessels, or boats ;

(g.) Prescribing the lights to be exhibited by steamers,

vessels, or boats ;

(lo.) Compelling every steamer, vessel, or boat to observe at all times the rules of the Board of Trade for the prevention of collisions and other accidents ;

(t 1.) Determining the maximum number of persons and quantity of goods to be carried by licensed steamers, vessels, or boats

2.) Requiring the number of persons and quantity of goods every steamer, vessel, and boat is licensed to carry, to be legibly exhibited thereon in the pre- scribed manner ;

(i 3.) Requiring the hirer of any steamer, vessel, or boat to declare the number of persons or the quantity of goods to be carried, and the person letting the vessel or boat for hire to record the same, and prohibiting the hirer from carrying or the person letting for hire from knowingly permitting to be carried any greater number of persons or quantity of goods ;

(14.) Prescribing the conditions under which licenses shall be held, and for the refusal or revocation of licenses in the discretion of the board ;

(15.) Prescribing fees or charges for surveying and regis- tration, and for the licensing of all steamers, vessels, or boats held for hire, and for the recovery of such fees and charges ;

(1 6.) Notwithstanding anything contained in the princi- pal Act to the contrary, imposing a penalty not exceeding one hundred pounds for the breach of any such regulation.

10. Every such regulation shall, upon approval by the Regulations to be

days after such publication if Parliament is then in session. and if not, then within fourteen days after the commencement of the next ensuing session.
