His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Board of Studies, Teaching and Educational Standards Act 2013.

Explanatory note
The objects of this Regulation are:

(a) to prescribe the Office of the Children’s Guardian as an agency in respect of which the Board of Studies, Teaching and Educational Standards may enter into an information sharing arrangement, and
(b) to specify certain offences under the Teacher Accreditation Act 2004 that may be dealt with by way of a penalty notice.

This Regulation is made under the Board of Studies, Teaching and Educational Standards Act 2013, including sections 16 and 23.

1      Name of Regulation

This Regulation is the Board of Studies, Teaching and Educational Standards
Amendment Regulation 2014.

2      Commencement

This Regulation commences on 5 January 2015 and is required to be published on the
NSW legislation website.

3 Amendment of Board of Studies, Teaching and Educational Standards Regulation 2013

(1) Clause 5 Exchange of information

Insert after clause 5 (c):

(d) the Office of the Children’s Guardian.
(2) Schedule 1 Penalty notice offences
Omit the matter appearing under the heading “Offences under the Teacher
Accreditation Act 2004”.
Insert instead:
Section 26 $500
Section 28 (1) $1,000
Section 28 (2) $1,000
Section 42B (1) $500
