Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Blue Mountains Local Environmental Plan 2005

(Amendment No 13).

2      Aims of plan

The aims of this plan are:

(a)

to reclassify Lot 1, DP 842612 (219 Great Western Highway, Warrimoo) from community land to operational land within the meaning of the Local Government Act 1993, and

(b)

to rezone Lot 1, DP 842612 (219 Great Western Highway, Warrimoo) from Recreation—Open Space to Living—Bushland Conservation, and

(c)

to rezone part Lot 3 and Lot 4, DP 11486 (14 Arthur Street, Warrimoo) from Living—Bushland Conservation to Recreation—Open Space, and

(d)

to rezone Lot 2, DP 26492 (8 New Street, Lawson) from Village—Housing to Village—Town Centre, and

(e)

to remove Lot 2, DP 26492 (8 New Street, Lawson) from Lawson Precinct VH–LA03—Village Housing Precinct to Lawson Precinct VTC–LA01—Village Town Centre Precinct, and

(f)

to permit development for the purpose of car repair stations on land within the Village—Neighbourhood Centre zone (other than land within Mount Victoria Precinct VNC–MV01—Village Neighbourhood Centre Precinct or Glenbrook Precinct VNC–GB01—Glenbrook Shops Precinct).

3      Land to which plan applies

This plan applies:

(a)

in respect of the aims set out in clause 2 (a) and (b)—to Lot 1, DP 842612 being 219 Great Western Highway, Warrimoo, as shown edged heavy black and distinctively coloured in Panel A

Clause 3

of Sheet 1 of the Map marked “Blue Mountains Local Environmental Plan 2005 (Amendment No 13)” and held in the office of Blue Mountains City Council, and

(b)

in respect of the aim set out in clause 2 (c)—to part Lot 3 and Lot 4, DP 11486 being 14 Arthur Street, Warrimoo as shown edged heavy black and distinctively coloured on Panel A of Sheet 2 of that Map, and

(c)

in respect of the aims set out in clause 2 (d) and (e)—to Lot 2, DP 26492 being 8 New Street, Lawson as shown edged heavy black and distinctively coloured on Panel A of Sheet 3 of that Map, and

(d)

in respect of the aim set out in clause 2 (f)—to all land to which Blue Mountains Local Environmental Plan 2005 applies.

[1]      Clause 32 Land use matrix

Insert in clause 32 (2) before the matter relating to development that is prohibited:

7      development that is allowed within the relevant zones only with development consent, except on land in Mount Victoria Precinct VNC–MV01—Village Neighbourhood Centre Precinct and Glenbrook Precinct VNC–GB01—Glenbrook Shops Precinct where it is prohibited.
