BLOOD DONATION (LIMITATION OF

LIABILITY) AMENDMENT ACT

No. 52 of 1987

AN ACT to amend the Blood Donation (Limitation of Liability)

Act 1985.

[Assented to 30 October 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Blood Donation (Limitation of

Liability) Amendment Act 1987.

Principal Act

2. In this Act the Blood Donation (Limitation of Liability) Act 1985*

is referred to as the principal Act.

Commencement

3.     This Act shall be deemed to have come into operation immediately

after the commencement of the principal Act.

Section 3A inserted

4.     Part I of the principal Act is amended by inserting after section 3

the following section

"

This Act not to apply to or in relation to liability under

Workers' Compensation and Assistance Act 1981

3A. (1) Nothing in this Act applies to or in relation to any liability of the Society, a hospital, a medical practitioner or any other person under the Workers' Compensation and Assistance Act 1981 to pay compensation, and to pay for the provision of other benefits, in relation to the disability or death, as a result of the contraction of AIDS, of a worker who was at the relevant time employed by the Society, hospital, medical practitioner or other person.

(2) In subsection (1)

"disability" and "worker" have the respective meanings given by the Workers' Compensation and Assistance Act 1981. ".
