(Amendment No 5)

1 Name of plan

This plan is Blayney Local Environmental Plan 1998 (Amendment

No 5).

2 Aims of plan

The aims of this plan are:

(a)

to rezone part of the land to which this plan applies from Zone No 1 (a) to Zone No 1 (c) under Blayney Local Environmental Plan 1998, and

(b)

to rezone part of the land to which this plan applies from Zone No 1 (c) to Zone No 1 (a) under that Plan, and

(c)

to rezone part of the land to which this plan applies from Zone No 1 (a) to Zone No 2 (v) under that Plan, and

(d)

to permit, with development consent, development for the purpose of a dwelling on the part of Lot 2 DP 614384 that is in Zone No 1 (a) under that Plan.

3 Land to which plan applies

This plan applies:

(a)

to the extent that it achieves the aims set out in clause 2 (a) and (b), to Portions 4, 35, 36, 67 and 143 and Part Portions 70 and 142, Parish of Graham, at Millthorpe, as shown edged heavy black on the map marked “Blayney Local Environmental Plan 1998 (Amendment No 5)—Sheet 1” kept in the office of Blayney Shire Council, and

(b)

to the extent that it achieves the aim set out in clause 2 (c), to that part of Lot 2, DP 614384, Vittoria Road, Millthorpe shown edged heavy black on the map marked “Blayney Local Environmental Plan 1998 (Amendment No 5)—Sheet 2” kept in the office of Blayney Shire Council, and

(c)

to the extent that it achieves the aim set out in clause 2 (d), to part of Lot 2, DP 614384, Vittoria Road, Millthorpe.

4 Amendment of environmental planning instruments

This plan amends Blayney Local Environmental Plan 1998 in the manner set out in Schedule 1.

[1] Clause 5 Definitions

Insert at the end of the definition of the map in clause 5:

[2] Clause 35

Insert after clause 34:

35 Development for certain additional purposes

(1)

Nothing in this plan prevents a person, with the consent of the Council, from carrying out development on land referred to in Schedule 10 for the purpose specified in relation to that land in that Schedule, subject to any conditions specified in that Schedule with respect to that land.

(2) Subclause (1) does not affect the application to the development of those provisions of this plan that are not inconsistent with that subclause or with a consent granted by the Council in respect of that development.

Schedule 10 Additional uses of land

(Clause 35)

Lot 2 DP 614384, Vittoria Road, Millthorpe—separate dwelling on such of that land as is within Zone No 1 (a).
