GLEESON CJ:   Now, you have indicated that you do not wish to supplement your written submissions with oral argument.

MR BLAKELEY:   I do, your Honour; not to the extent that I need to make – I would rather rely on my submissions.

GLEESON CJ:   Yes, you are perfectly entitled to do that.  Just take a seat then.

In this matter we have considered the written submissions made on
behalf of the applicant and, of course, the submissions on behalf of the respondents and we have come to the conclusion that there is insufficient reason to doubt the correctness of the decision of the Full Court of the Supreme Court of Western Australia to warrant the grant of special leave to appeal.  So, the application is refused with costs.
