1      Name of Plan

This Plan is Blacktown Local Environmental Plan (Amendment

No 221).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land to which Blacktown Local Environmental Plan

1988 applies.

[1]      Clause 3 Land to which plan applies

Omit clause 3 (2). Insert instead:

(2) This plan does not apply to the land to which State Environmental Planning Policy No 29—Western Sydney Recreation Area or State Environmental Planning Policy (Western Sydney Parklands) 2009 applies.

[2]      Clause 6 Interpretation

Omit the second definition of integrated housing and the definition of liquor outlet from clause 6 (1).

[3]      Clauses 6 (2), 17 (1) (d) and (i) and 25 (3)

Omit “Water Board”, wherever occurring.

Insert instead “Sydney Water Corporation”.

Omit “Prospect Electricity”. Insert instead “Integral Energy Australia”.

[5]      Clause 9 Zone objectives and development control table

Omit “liquor outlets;” from item 4 of the matter relating to Zone No 1 (a) (General Rural Zone), Zone No 1 (b) (Rural Residential Zone), Zone No 4 (a) (General Industrial Zone), Zone No 4 (b) (Light Industrial Zone), Zone No 4 (c) (Special Industrial Zone) and Zone No 4 (d) (Huntingwood Industrial Zone), wherever occurring.

Insert instead “Rail Corporation New South Wales”.

A development application that was lodged with the consent authority, but that was not finally determined, before the commencement of the amending plan is to be determined as if the amending plan had been exhibited but not commenced.
