Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Blacktown Local Environmental Plan 1988 (Amendment

No 218).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Aims of Plan

This Plan aims to amend Blacktown Local Environmental Plan 1988 so

as:

(a)

to rezone part of the land to which this Plan applies from partly Zone No 5 (a) (the Special Uses—General Zone) (the land being variously used for church, club, water, sewerage and drainage or school purposes), partly Zone No 6 (a) (the Public Recreation Zone) and partly Zone No 3 (a) (the General Business Zone) to Zone No 2 (a) (the Residential “A” Zone), and

(b)

to rezone part of the land to which this Plan applies from Zone No 5 (a) (the Special Uses—General Zone) (the land being used for cemetery purposes) to Zone No 2 (b) (the Residential “B” Zone), and

(c)

to include a house and shed as a heritage item, and

(d)

to reclassify part of the land to which this Plan applies from community land to operational land within the meaning of the Local Government Act 1993.

4      Land to which Plan applies

(1)

With respect to the aim set out in clause 3 (a), this Plan applies to:

(a)

Lots 12 and 13, Section 2, DP 5094, Rooty Hill Road North, Plumpton, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 1 of the map marked “Blacktown

(b)

Lot 11 and part of Lot 12, DP 1075198 and Lots 21 and 22, DP 1075194, Luxford Road, part of Lot 23, DP 1075194, Tongariro Terrace, Lots 24 and 25, DP 1075194, Kidd Close, Lot 29 and part of Lot 30, DP 1075194, King Square and Lot 44, DP 251473, Macarthur Way, Bidwill, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 2 of that map, and

(c)

Lot 32, DP 983, Rooty Hill Road North, Rooty Hill, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 3 of that map, and

(d)

Lot 1, DP 805733 and Lot 2, DP 242671, Vermont Court and Leabons Lane, Seven Hills, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 4 of that map, and

(e)

part of Lot 102, DP 1077484, Hyatts Road, Plumpton, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 5 of that map, and

(f)

Lot 168, DP 270391, Edgewood Drive, Tilbury Avenue and Yarrandale Street, Stanhope Gardens, as shown coloured light scarlet, edged heavy black and lettered “2 (a)” on Sheet 7 of that map.

With respect to the aim set out in clause 3 (b), this Plan applies to Lots 1 and 2, DP 456608, Lots 34 and 35, DP 456650, Lot 36, Section B, DP 15587, Lots 56–58, Section C, DP 15587, Eskdale and Kington Streets and parts of Pinegrove Terrace and the Great Western Highway, Minchinbury, as shown coloured light scarlet, edged heavy black and lettered “2 (b)” on Sheet 6 of that map.

With respect to the aim set out in clause 3 (c), this Plan applies to Lot Y, DP 31211, 193 Flushcombe Road, Blacktown, as shown edged heavy black on Sheet 8 of that map.

(4)

With respect to the aim set out in clause 3 (d), this Plan applies to Lot 44, DP 251473, Macarthur Way, Bidwill, as shown edged heavy black on the map marked “Classification Map No 30” deposited in the office of Blacktown City Council.

[1]      Clause 6 Interpretation

Insert in appropriate order in the definition of the map in clause 6 (1):

[2]      Clause 39 Classification or reclassification of public land as operational land

Omit “cited at the end of the description of the parcel” from clause 39 (4).

Insert instead “that inserted the description of the parcel into that Part”.

[3]      Schedule 2 Heritage items

Insert under the heading “Blacktown” after the matter relating to the former

Blacktown Primary School, Flushcombe Road:

House and shed—Lot Y, DP 31211, 193 Flushcombe Road, as shown edged heavy black on Sheet 8 of the map marked “Blacktown Local Environmental Plan 1988 (Amendment No 218)”.
