Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Births, Deaths and Marriages Registration Act 1995.

Explanatory note
The object of this Regulation is to amend the Births, Deaths and Marriages Registration Regulation 2006 to provide for the Registrar of Births, Deaths and Marriages and the Commissioner of Police to enter into a memorandum of understanding with respect to access by members of the NSW Police Force to certain entries in the Register kept under the Births, Deaths and Marriages Registration Act 1995 regarding changes of names.

This Regulation is made under the Births, Deaths and Marriages Registration Act 1995, including section 46 and section 62 (the general regulation-making power).

Births, Deaths and Marriages Registration Amendment

(Change of Name) Regulation 2009

under the

Births, Deaths and Marriages Registration Act 1995

1      Name of Regulation

This Regulation is the Births, Deaths and Marriages Registration
Amendment (Change of Name) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3      Amendment of Birth, Deaths and Marriages Registration Regulation 2006

Clause 8 Registration of change of name

Insert at the end of the clause:

(2) The Registrar may enter into a memorandum of understanding with the Commissioner of Police with respect to access in accordance with section 46 of the Act by members of the NSW Police Force to entries in the Register regarding changes of names.

(3) The memorandum of understanding may be amended,
revoked or replaced from time to time.
