Births, Deaths and Marriages Registration (Amendment) Act 1998

An Act to amend the Births, Deaths and Marriages Registration Act 1997

The Legislative Assembly for the Australian Capital Territory enacts as follows:
Short title
This Act may be cited as the Births, Deaths and Marriages Registration (Amendment) Act 1998.
Commencement
Section 1 and this section commence on the day on which this Act is notified in the Gazette.
Sections 3 to 7 (inclusive) commence, or shall be taken to have commenced, on the day on which the provisions referred to in subsection 2 (2) of the Principal Act commence or commenced, as the case requires.
Principal Act
In this Act, “Principal Act” means the Births, Deaths and Marriages Registration Act 1997.1
Application to register change of adult’s name
Section 18 of the Principal Act is amended by adding at the end the following subsection:
An application under this section shall be accompanied by the determined fee.”.
Application to register change of child’s name
Section 19 of the Principal Act is amended by adding at the end the following subsection:
An application under subsection (1), (2) or (5) shall be accompanied by the determined fee.”.
Entries to be made in the Register
Section 21 of the Principal Act is amended by inserting in subsection (1) “, on payment of the determined fee” after “shall”.
Application to alter Register to record change of sex
Section 24 of the Principal Act is amended by omitting from subsection (4) all the words after “section” and substituting:
“shall—
(a)set out, or be accompanied by, the prescribed particulars; and
(b)be accompanied by the determined fee.”.
